Hello again everyone, my mate John has run afoul of Merton traffic enforcement.

He was issued a 50R PCN by Merton Council, No right turn for vehicular traffic into the Waitrose on Coombe Lane, which incidentally seems to be quite a good little earner for Merton Council - https://www.whatdotheyknow.com/cy/request/r...n_fine?unfold=1

From the photographic & video evidence it would appear John did turn right. He was visiting about 8 different clients for the first time that day & has only a hazy recollection of events & pretty much none of turning into this Waitrose carpark. Looking at this thread for the same thing - http://forums.pepipoo.com/index.php?showtopic=122403 it seems there may not be much to complain about with the signage (hope to be corrected on that!) but I was wondering if there might be something awry with the PCN itself. I've blanked out all identifying info, please let me know if you need to see any of it.

As always, any help advice, info most gratefully received.

Dates are OK.

Well you could post the video and pics and check the time on PCN too against pics.

I don't think there are flaws with Merton PCN wording.

The images from Merton. Not sure how to load it but the film clip shows the same thing with the same time.

EDIT: There is one more photo in Merton's evidence folder which shows the front of the car (possibly with the lights out). Nothing around the car to place it at the scene or in context.
I can't read the reg. # in any of the first 3 pix they have supplied, is this the best quality photos they have?

So, does anyone see anything to base an appeal on here or does John man up & pay the piper?

It doesn't look good but to be sure, give us a link to the location on google street view and PM the PCN details to me or stamfordman so we can get hold of the video.

Is this the entrance where you have to go past it, and turn round at a little roundabout and come back so you can turn left into Sainsburys ? If it is, there has been a recent post on this one.

I haven't spoken to John about this but I don't think there's a roundabout anywhere near that would make such a move possible.

Sorry, I think my memory is bad ! The other case was a Sainsburys NRT case.

As you have intimated, the only appeal that comes to mind is the PCN containing fatal errors. These are much fewer in number now, not least because of this forum over the years has caused councils to amend them to be correct. Most London ones are kosher now, but you never know. Then there is the added data, such as location and times etc which they can get wrong.

Well, I've posted everything EXCEPT the video of the alleged offence (which I'm not sure I know how to do) & so far there doesn't seem to be a fatal flaw.

Is that the end of the road?

Well no, you've posted a link to Waitrose, what we need to see is

1) A link to the location on google street view
2) The video

If we see this and there's no viable way to challenge we will say so, at the moment we simply don't know.

I'll try to figure out a way to post the video

Use flash video downloader https://chrome.google.com/webstore/detail/f...jenkahhlhccpdbc to download the video, then post it on youtube, vimeo or similar.

If you want you can post the PCN details to me or stamfordman and we'll do it for you.

I'm not sure the illumination of the right hand side sign is working, are you able to pop back and check?

It's not going to be working CP it ain't there

https://www.google.co.uk/maps/@51.4095042,-...6384!8i8192

Its thin gruel though, much needs be made of the fact that when turning right your eys are drawn to that side of the road and that there is no advance warning

Thanks cp, I can see it.

Dunno if the sign is lighted up or not, I'll ask. Also I'll get John to check on the angle of that NLT sign on the R. It looks like it is turned slightly away, to the R as you approach it, from oncoming traffic.

As PMB points out, the right hand side is not illuminated. It's hardly compelling stuff but it's all I've got.

Unfortunately John will not be able to go back to the scene of the alleged crime anytime soon. He has 14 days from the 27th of January to pay or the fine goes from £65 to £130.
