Hi Guys
I received a notice for stopping in the junction box, but in my argument, it was unforeseeable as there was a container in front of me which suddenly stopped although the signal light further down was showing green. Also, there seems to be misprints on the PCN with the amount payable. Let me know if there is anything I could do to escape this case. Thanks and keep up the good work I got the video too but not sure how to allow everyone to see without giving the PCN number and number plate to view online :/ |

May be your lucky day as, is the penalty charge amount missing on the PCN?
As for the event being 'unforeseeable' - well no - the idea is you wait for a gap big enough for your car before proceeding or gamble and possibly lose (although if the truck had exploded they may have let you off). Don't worry about the details - post the video anyway as this is the key evidence. But the PCN may be a saviour. Let me know if there is anything I could do to escape this case. Surely that's easy for you? Just go back in time and get it right. It was a yellow box not a police box. |

The PCN charge amount is not exactly missing, but it's printed a line under where it should have been printed. So it's like on the second line with the words. Is it not clear from the picture attached? This is something that could win at adjudication is not a certainty as some adjudicators will say the PCN is "substantially compliant" as the £130 is there but displaced a bit. Frankly, following large vehicles like this closely into the yellow box is not wise, and it will be difficult to overturn this PCN. The council are unlikely to give way, so you'd end up at adjudication arguing about the "missing" penalty. Discount option is lost if you do this.

* But looking again you aren't stationary the whole time and there is some space ahead of you. almost enough to get out of the box. It would be a gamble with an adjudicator. I don't think you can read the full penalty amount - wait for others to comment on whether that's good enough to appeal on.
