NIP Details and Circumstances
What is the name of the Constabulary? - Date of the offence: - May 2018 Date of the NIP: - 57 days after the offence Date you received the NIP: - 59 days after the offence Location of offence (exact location as it appears on the NIP: important): - A3, between A272 Petersfield & Ham Barn Roundabout, Hampshire, United Kingdom Was the NIP addressed to you? - Yes Was the NIP sent by first class post, second class or recorded delivery? - Not known If your are not the Registered Keeper, what is your relationship to the vehicle? - n/a How many current points do you have? - 0 Provide a description of events (if you know what happened) telling us as much about the incident as possible - some things that may seem trivial to you may be important, so don't leave anything out. Please do not post personal details for obvious reasons - Remember seeing the police car under the bridge - knew we were speeding as I'd just pointed out to hubby to watch his speed (new car). He slowed, but unfortunately not enough. NIP Wizard Responses These were the responses used by the Wizard to arrive at its recommendation: Have you received a NIP? - Yes Are you the Registered Keeper of the vehicle concerned (is your name and address on the V5/V5C)? - Yes Did the first NIP arrive within 14 days? - No Was there a valid reason for the NIP's late arrival? - Yes Although you are the Registered Keeper, were you also the keeper of the vehicle concerned (the person normally responsible for it) at the time of the alleged offence? - Yes Were you driving? - Yes Which country did the alleged offence take place in? - England NIP Wizard Recommendation Based on these responses the Wizard suggested that this course of action should be considered:
Generated by the PePiPoo NIP Wizard v3.3.2: Wed, 04 Jul 2018 13:00:39 +0000 Hi all, I'm pretty sure we're bang to rights on this one - hubby was definitely speeding, the NIP was late but we'd only just bought the car a couple of days before so the registered keeper on file at the DVLA would have been incorrect. But having never had a speeding ticket before, I do have a couple of (hopefully) simple questions: - According to their letter he'll be getting a conditional offer - so that'll be 3 points (he was 1 MPH too fast for a course), but what fine will it be? Is it £100 or is it income based? - How long is this like to take before hubby gets his licence back after he sends it off? We're going on holiday end of August and need to take his licence with us - will 8 weeks be long enough if we send the NIP back asap? This post has been edited by Vampgirl: Wed, 4 Jul 2018 - 13:05 |

The fine is fixed at £100. The licence should certainly be back within eight weeks, they do not even have to do anything with it other than process the fixed penalty.

That's a Conditional offer of a fixed penalty, and yes the penalty is fixed at £100 and the 3 points.
What dates in August is the holiday, when did you get the NIP exactly? -------------------- There is no such thing as a law abiding motorist, just those who have been scammed and those yet to be scammed!

Thanks for the confirmation - I thought it was still £100 for a COFP and that the new fines only relate to when it goes to court.....but I wasn't totally sure as most of the sites talking about the new levels of fines aren't specific on that point.
The NIP arrived in the post today - so we'll post it back to them tonight. We're not off on holiday until 30th August, so hopefully it'll all be done and dusted by then. Just need to work out now whether we have to proactively notify insurance companies (Direct Line & Comfort/Aviva) or if we should wait until the next renewal. |

A CoFP is usually offered up to 95mph in a 70. The income related fines only come into play at court. Just need to work out now whether we have to proactively notify insurance companies (Direct Line & Comfort/Aviva) or if we should wait until the next renewal. Read the wording of the policy. Normally, it's renewal but... -------------------- RK=Registered Keeper, OP=Original Poster (You!), CoFP=Conditional Offer of Fixed Penalty, NtK=Notice to Keeper, NtD=Notice to Driver
PoFA=Protection of Freedoms Act, SAC=Safety Awareness Course, NIP=Notice of Intended Prosecution, ADR=Alternative Dispute Resolution PPC=Private Parking Company, LBCCC=Letter Before County Court Claim, PII=Personally Identifiable Information, SAR=Subject Access Request Private Parking - remember, they just want your money and will say almost anything to get it. |

The news articles on the new sentencing guidelines was of a woeful quality and very misleading.
We're not off on holiday until 30th August, so hopefully it'll all be done and dusted by then. In that case I'd reply ASAP and yes you should have it back in time. -------------------- There is no such thing as a law abiding motorist, just those who have been scammed and those yet to be scammed!
