Dart crossing fines x 13 not notified till my card was clamped!

Hello beautiful people,

I have been floating arount the web trying to find a bit of advice on what to do about my problem and kept coming back to here so thought I would try and ask it here.

On my way to work at 6 am I found some bailifs clamping my car. They said it was due to 15 different fines 13 for the dart crossing and 2 for parking tickets at the couincil where my house is.

I had not been sent any notices for any of these fines, I moved about 3 years ago and updated my information. I have previously had notices of fines sent to my current adress so I don’t know why these were never sent to me.
The bailif paperwork had my old adress on it.
The ballif clamped my car infront of my current adress which is down a side street no where near a main road which I find suspisious.

Any way they demanded immediate payment that I couldn’t afford. I commute from London across the dart every day to work so my car is necessary for work. I managed to pay half the fees and a payment plan for the rest.

The reason I din’t pay the 13 times I crossed the dart was because I belived my work was paying for it (its my own car) but it tirns out they wern’t.

I wouldnhave been happy to resolve the fines if I had been noified but I was not.

Does anyone have any examples of what I should write on the forms that I need to send to the court regarding these fines?
I know I have to fill out the forms for each ticket but I don’t know how detailed I need to be.
Should I explain that I belived work was paying and that if I had recived a fine the first time I would have set up my dart crossing accoubt straight away? (As soon as my car was clamped I opened an accoubt to pay for my future journeys.)

Do I need to send any evidence on when I moved house?

First things first - if you are the registered keeper of the car go get the V5C reg doc now and check the name and address on it. Don't assume.

Check the address on your V5. Don't just answer 'it's correct'; actually go and look at it.

Thanks I will check but I have had multiple oher noices sent to my house since moving here.

Just realised that I never got a resonce from me updating my adress, but I can prove precious notices sent to my current property.

That doesn't mean anything, what's the address on your V5C? Don't assume it's correct, actually check it.

It's a criminal offence to fail to update your V5C (and under the Vehicle Excise and Registration Act 1994 that doesn't just mean sending it off, you must chase a response if you don't get it within a reasonable amount of time). No court will accept that not chasing a reply within 3 years of moving is reasonable. If the penalties were sent to the correct address as per DVLA, there's not much you can do at this point. Sorry I know this isn't what you want to hear, but it is what it is.

Why did you assume that work would pay these fines? If you are the RK, they would have no knowledge of these fines.
Why do you find the fact that the Bailiffs clamped your car off a main road suspicious? Bailiffs can clamp cars just about anywhere,

From a legal point of view it would appear you are stuffed, other than for the fact that dart charge have a reputation for reasonableness in the civil enforcement world.

What you need to do is talk to them, its your fault so be very contrite explain that £1365 + bailiffs fees is very harsh see if you can do a deal or better yet if they will allow an out of time witness statement without objection. If they do you can at least get the Dart ones reset to PCN level and no bailiffs fees for those

Just bear this in mind, if one of your Out of Time witness statements is accepted....they will all be. If one is rejection, the same thing will happen. With multiple applications, it is always the case that advice sought be sought beforehand.

It is difficult to advise people what on what to put on the forms as every case if completely different. What I would suggest that you do, is to make sure that you now open a Dart Charge account. This would get taken into consideration by Highways England when making their decision as to whether to allow you to file your witness statements late.

I opened a Dart account as soon as I got my car unclamped from the baliffs because I had to go to work across the dart that day.

I haven't had time to do anything about this yet. My wife threw away the old notices that came to the house from the local council. So I suppose I will just be at their mercy with my out of time statements.
