Hello all,

Recently received a little day brightener through the post from Euro Car Parks. A car I own over stayed at a free car park by around 18 minutes.

I've had a read through the forum and haven't found any glaring errors on their part to give any wiggle room, but £50 is £50 and I don't particularly want to part with money at the moment unless its completely necessary.

Whats my next move, if I have one?

Next move is to edit so that the identity of the driver cannot be inferred. The driver drove and parked, you, the keeper, received the notice

Dear Sirs,

I have just received your Notice to Keeper xxxxx for vehicle VRM xxxx

You have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to give the invitation to keeper in the format prescribed by section 9 (2) (e) of the Act. You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper.

There is no legal requirement to name the driver at the time and I will not be doing so.

I do not expect to hear from you again, or your debt collectors, except to confirm that no further action will be taken on this matter and my personal details have been removed from your records.

Yours etc

There is no period of parking. Moving in front of a a camera, by definition cannot be parking

They will probably reject but then POPLA should be successful

So this week I got a letter back rejecting the letter I sent (as expected). Is now the time to go forward with a POPLA complaint? In the letter they refer to an ICO complaint form
