Hi,

This was received a couple of days ago - a pcn for 50R - performing prohibited turn - No right turn. It was on Conduit lane / montagu RD N19.

I've attached photos of the PCN, google maps photos of where the driver was going etc. I will also attempt to attach the video the council have used as evidence. I can't see any prohibition signs? Also multiple other people are turning right too.

Are their any grounds for appeal?

Ok - I've received a letter from tribunals stating all evidence should be received prior to 29th feb. When do I find out if the council is going to contest the case or not?

Assuming you registered the appeal online and not by post, you can log into the tribunal website and see if the council has uploaded its evidence pack. It must upload at least the PCN, the representations and the Notice of Rejection within 7 days of the date it received notification that an appeal had been filed, failure to do so can be a procedural impropriety.

I've just checked - they've uploaded nothing yet as far as I can tell - I'll wait another week to see if they have done anything.

Hi,

I've checked again - still no evidence uploaded. I wonder if I'm checking the wrong place - could you guide me if you're familiar as to where to look? Should I just upload our evidence anyway?

Hi,

A file called EA DNC Request has been uploaded by the enforcing authority. Evidence type is "EA task". When I click on it - it's a PDF file

It says these things -

EA DNC Request
Case reference xxxxxx
Appellant name: xxxx
Task details:
EA DNC Request task created for Case reference xxxxx

The rest is blank. I've replaced the real info with x's.

It doesn't say the date or time it's been uploaded.

DNC means the authority Does Not Contest, i.e. you've won. In a few days the tribunal will email you saying that the appeal has been allowed without any of the evidence being considered, because the authority has chosen not to contest. To be honest, it's hardly surprising.
