FightBack Forums _ Council Tickets & Clamping and Decriminalised Notices _ PCN-50J Prohibited Turn (Camera Enforcement)

Hello! First post to the forum (don't kill me haha)!

I have tried scouring this forum for potential answers and the closest post i can find to my situation is this:

http://forums.pepipoo.com/lofiversion/index.php/t103806.html

My situation:

I have been taking this right turn for many years! I did not notice that very recently the council put up a sign saying no right turns. I had to revisit the area after receiving this PCN to check the signs were even there.

Possible grounds for appeal:
1 - No contravention shown in evidence submitted (right turn prohibited sign not shown in evidence and direction of prohibited turn not stated in PCN) - see above post
2 - Signage has only recently been put up, as evidence in below google street view shows. Waze actually directed me to take the turn, so even that has not been updated! Also see evidence video of the few people in-front of me also making the turn!

This is the junction on Google Street View: https://www.google.co.uk/maps/@51.5603065,-0.1970002,3a,75y,355.95h,83.04t/data=!3m6!1e1!3m4!1sej1TwU0jY6zy7rHTd1omLg!2e0!7i13312!8i6656

PCN Letter/Evidence photos/video: https://www.dropbox.com/sh/6hsw53vpl8moz0j/AAALOS1RxffEA4LX0mVX4pOMa?dl=0

Any help is appreciated!

Thank you.

No pics of any signage and several cars going through this one...

Lots to look at on this one . PCN is duff as you say, and for other reasons Can you get photos of the signs ?

Ask the council for the TMO this is vital for a new restriction

So they have prevented the "rat run" through the back roads to avoid Finchley Road. I used to go that way a lot in the past.

Briardale Gardens gets you into Platts Lane and then you through some other back streets to get to Heath Drive, and subsequently probably Frognal, cross Arkwright Road and emerge at the junction of Frognal and Finchley Road, having cut out a load of traffic lights.

Thanks for the quick replies, I will take pictures of the signs on my way home this evening!

Earl Purple, yes unfortunately they have! Saves at least 15 minutes compared to the barbaric 7:30am traffic going down Finchley Road!

I am expecting more PCN's to arrive between the time I have been caught for this PCN & now for doing the same route! Shame!

For some reason they republished the Notice:-

The Orders came into operation on Monday 9th April 2018.

Don't think you can complain much about the signage...

Haha not complaining about the signage (Ive making that turn for years and only recently have they implemented the roadsigns)!

Does the PCN still stand as evidence submitted to me does not show any visible signage and therefore no contravention? Also the PCN does not state the direction of turn..

The PCN is wrong, but that's your only shot. The council will not accept so do you want to risk the discount?

If you have more, or suspect you may get some I would phone the council and ask them to send them. This might help you claim a continuing contravention

I would. Is the restriction in force only on the stated days at the stated times? Or is it always in force, with an exemption for cycles during the stated days and stated times? It's not going to win the case, but there is definitely scope for ambiguity.

And what did you say,

Made 2 points -

1 - No contravention shown on evidence (evidence shows me making a turn but no signage displayed on PCN evidence submitted to me)
2 - Nowhere on the PCN does it show what I contravened (left or right turn)

The second point should be a winner but will likely need to go to adjudication to be so. the first is not relevant they are not required to show evidence on the PCN only state what the believe the evidence bit would come later

I've received a PCN for the same right turn, what was your outcome?

Dear Pew

Please start your own thread as otherwise readers can get two cases muddled up which may lead to disaster.

Thank you
