Hi All
The Star Trek Federation recieved a PCN yesterday (20 Feb) for an alleged parking infringement in a universe/supermarket car park committed on 18 Jan. Thats over a month later. The captain is 83 years old and he/she cant remember or tell from the photos where it happenned. The alleged offence is that the Enterpise was not parked fully inside the bay. Is there a time limit by which The federation should have received the PCN? Are there grounds for appeal based on the age of the captain etc? Is there a time limit by which he should have received the PCN? Yes and no. For keeper liability there are strict requirements in regards to timings. I'm presuming nothing was placed on the car at the time? If so, they had to deliver within 14 days for such keeper liability. Does the PCN state any such liability? Are there grounds for appeal based on his age etc? Thanx for your fast response. I am not sure what you mean by keeper liability. There is a section on the back titled Transfer of Liability to fill in the Enterprise was in someone else's possession at the time of the ticket. Can you explain keeper liability please? Whats even more bizarre is that PCN has an Issue date of 15 Feb and an Incident time /date of 18 Jan. Therefore it was clearly printed after the 14 days. PS. The Captain does have a blue badge but The Enterprise was parked in a Mother and Child place. As we dont know which universe/supermarket I can't check if there were any Disabled bays there or not. The caption has not mentioned any notice on Windscreen. (But then it is a massive windscreen on the Enterprise.)

STOP identifying the driver. NOW. EDIT YOUR POSTS. "The driver" parked the vehicle. The person who receievd the NtK is the Keeper. |

The parking companies scan the forums, not just this one, and pick up admissions of who was the driver. To turn a win into a loss just ignore the requests to edit.

It would help if the rest of the universe had something to work with, like the NTK suitably redacted, the signs and possibly a google street view link
It does look as though they have not delivered it in time. |

Since we dont know where this happened its impossible to provide photos of signs, street view or even quadrant / sector.
As for my writing style (edits) I am sure you will agree nosferatu1001 that it is far more entertaining that the usual stuff whilst also fulfilling your requirements. If that upsets you then I dont know what to say. It would help if the rest of the universe had something to work with, like the NTK suitably redacted, the signs and possibly a google street view link It does look as though they have not delivered it in time. Do you have the official timeframes that they are required to comply with, so I can quote them in my letter to the space cowboys ? Here is the PCN. Is that the same as the NTK ?
PCN Page 1 PCN Page 2 All it says that it happened in Nuneaton. Now Nuneaton is not huge but do they need to be a bit more specific? Whats the best course of action. Thanx in Advance |

OK, that makes it easy
I am the keeper of vehicle xxxxx and have received your PCN xxxxx The PCN fails to comply with the requirements of schedule 4 of the Protection of Fredoms Act 2012, namely, but not limited to, failing to deliver the Notice to Keeper within the relevant time of 14 days, contrary to section 9 (4). I, as the keeper, cannot therefore be held liable for the actions of the driver. There is no legal requirement to name the driver and I will not be doing so. I do not expect to hear from you again other than to confirm that there will be no further action against me in this matter. Is that enough? Wasn't that simple! |
