I got a PCN on 15/06/2020 as my car was parked outside my house in a resident's parking place. I knew nothing about the permit before I searched online for all possible reasons for getting the PCN. I had just moved and had bought the first car ever in this country. When I realised what was the problem, I purchased the parking permit right away. I challenged the PCN but it was rejected and in the Challenge rejection letter which was signed only with a signature but not a name I was told to wait until I receive a Notice to owner form. I never received it and then almost 9 months after my car parked in the parking space outside the house was clamped out of blue. Enforcement agents gave my scared to death daughter (16 years of age) Notice after entry (I was not at home). The notice did not have Warrant/order number or date, stated that control of goods taken on a highway (!) and that the sum outstanding must be paid by that day 14:05. with the words "or a payment arrangement agreed" crossed out by hand.
I complained to council about not getting any correspondence. They confirmed that all correspondence was posted to the address provided by the DVLA. at that time the address hadn't been changed but when I challenged it I gave a new address and explained situation. Nevertheless, my challenge was rejected noticing me in letter with my current address on. So the car is clamped outside my house since 20 of March. Any ideas? |

Did you get an acknowledgement e-mail?
Sometimes councils will tell the bailiff to remove the clamp while the matter is decided but not always. In about three weeks time start phoning TEC for any updates and then increase how often you phone. 0300 123 1059 -------------------- |

We would appreciate your patience during this difficult time. Do you mean 3 weeks or more the car can be still clamped? But in that case enforcement is not stopped, just paused. In council's email sent last week: Please note that your vehicle will remain clamped until we have received notification from the traffic centre that an OOT has been filed or payment is received. |

No, enforcement WILL be suspended as soon as the bailiff is informed of your application.
The decision takes 3-6 weeks, hence the reference to 3 weeks. -------------------- |

MY car is still clamped. Well it takes time for word to filter down and decisions to be made. I only said the bailiff might release it while a decision is made. You can always pester the council to see what they say? -------------------- |

OP, this is not a guessing game.
Send a copy of your OOT and TEC's auto response to the council. Normal process: You submit OOT; TEC register promptly; TEC notify authority who are then obliged to remove the clamp, they are responsible albeit that in practical terms they'll instruct their bailiff. But TEC are operating in slow mode. So tell the authority yourself, with TEC's acknowledgement, and add that you trust that they will arrange for the vehicle clamp which was applied to your vehicle by *** on *** to be removed forthwith while TEC determine the matter. The clamp is finally removed after I did exactly what hcandersen advised. Their answer:
"I can confirm the clamp has now been removed pending the decision of the out of time statutory declaration." Many thanks to all of you for help. Very much appreciated. What do you think the decision will be knowing all circumstances? |
