I have just received a NIP through the post. It is within the 14 days. Looking at the photographs of the offence it shows my car on a main road I know well. When I look at the site details on the public access system it shows the location of the speed camera van, however where it is positioned in the photographs it is impossible for the camera to have spotted me where my car is on the offence photographs (opposite direction, around a bend in the road etc). Does this actually matter? Would it be a ground to appeal the NIP? Do the police have to inform you accurately where the camera was at the time of the offence?

No, the police have to tell you where they caught you, not where they were, if the photo proves you were speeding, then that will be sufficient provided it is not too far from where they say it was, and remember when looking that those cameras have a very considerable foreshortening effect.

The location of the alleged offence is merely directory and you do not seem to have been disadvantaged in identifying the location.
The camera clearly captured you. -------------------- RK=Registered Keeper, OP=Original Poster (You!), CoFP=Conditional Offer of Fixed Penalty, NtK=Notice to Keeper, NtD=Notice to Driver
PoFA=Protection of Freedoms Act, SAC=Safety Awareness Course, NIP=Notice of Intended Prosecution, ADR=Alternative Dispute Resolution PPC=Private Parking Company, LBCCC=Letter Before County Court Claim, PII=Personally Identifiable Information, SAR=Subject Access Request Private Parking - remember, they just want your money and will say almost anything to get it. |
