So I got this PCN for a no right turn and I did appeal it within 14 days but it had to be a formal appeal and it come back rejected. I will send my appeal off to the adjudicators but wonder if anyone can suggest anything that will help my case. On my appeal to Havering council I wrote; "The signage was inadequate to inform the road user of the no right turn. The one and only sign set on the opposite side of the road and within a bus stop may have been obscured from view with a large vehicle or bus. Further more it is also set back meaning it could be unclear what turning is restricted with an additional turn into the conservative headquarters. This can be seen in the picture provided by me and the council own picture with the turning obscured with a black box". The appeal has been allowed. Many thanks to PMB and CP.
Adjudicator's Reasons This PCN was issued for the alleged contravention of performing a prohibited right turn in Western Road at 8.44am on 9 May 2020. I have reviewed the CCTV footage and still images submitted by the Council. There is a no right turn sign mounted to a post on the left hand side of the road immediately before the turning taken by Mr Grant's van. Mr Grant appeals because this sign is next to a bus stop and he believes that the signage may have been obscured from view by a bus. The Council says that the footage shows no evidence of a bus in the bus stop. If the sign was obscured from view by a bus, then that would render the otherwise compliant signage inadequate. The Council's footage does not show the length of the bus stop and it is impossible to say whether or not there was a bus there. This leaves doubt as to whether or not the signage was adequate and, for that reason, I am not satisfied that the alleged contravention occurred.
