Jurisdiction: England and Wales

1) Is the offence of committing an act, here being the fabricating or disposing of evidence, tending and intending to PERVERT the course of public justice, an indictable offence?

2) If it is indeed an indictable offence, in what circumstances could a CITIZEN'S arrest of a person reasonably suspected by the arrestor of being guilty of that (already committed) offence be lawful?

3) Is the answer to 2) different if the person reasonably suspected of that offence a POLICE OFFICER, and the police are reasonably suspected by the arrestor of engaging or having engaged in a cover-up of a colleague, and therefore it is not practicable that a constable would make the arrest instead?

Thank you.

This forum focuses on motoring offences.

You might find Legal Beagles more suited to your inquiry:

Citizens Arrest for suspected PCOJ?

You 'aving a laff ?
Sorry but I got to ask.

AFAIK, citizens arrest can only be lawful when it is impractical for the police to make the arrest and is necessary to prevent injury, loss or damage to property or tp prevent escape.
None of which can I see applying to PCOJ unless the suspect is doing a runner.

I believe it is an indictable offense but that is not the only requirement

Step one in any legal advice is "will it serve any useful purpose?". If no, don’t waste your time. In this case the answer is clearly no.

I think the OP has been looking at FoTL sites - it's the sort of nonsense they'd come up with!

If you can arrest a judge why not the 5-0?
