Parking Charge Notice From HX Car Park Management, An unfair parking charge in my opinion...Need Help

Hiya people, it is not great to be here but it is great to be here wink.gif

the driver got a parking charge notice from HX Car Park management which i believe to be unfair.

the driver parked up for an important appointment at the job centre in wigan. There is a small car park beside the job centre where the driver parked while the driver went in to get change for the machine, while in there the driver was running out of time and went to the appointment, after the appointment the driver came out and paid for parking then left.

According to the letter that arrived over 10 days later the contravention of the terms and conditions was that the driver failed to pay for a ticket within 10 minutes.

I believe its totally unfair to charge £60-£100 for not very long and especially so because parking was paid for. No intent was there to try and get out of paying for parking.

I would appreciate any help and respectfully request you go easy on me if i posted this in the wrong area or have broken any rules unwittingly.

EDIT: I'll be nipping to the car park today to takje images of any signs and warnings, the driver doesnt recall any sign saying the driver only had 10 minutes

THE DRIVER parked the car. NEVER use "i", "he", "she" etc.

There's an existing thread with most of the details here and here (with likely signs).

They are quite litigious so a court claim is possible.

Yeah it came on Monday. It was sent to an old address and we only got the letter last night from the person that lives there.

There's no dates in there to check but if the parking was before the 28th May then they have missed the time. Was the delay because the keeper forgot to update their V5 with the DVLA, a real penalty with upto £1000.

Strictly speaking they have not complied with the requirements of POFA 9 (2).

The incident date was on the 1st of this month. And yeah the keeper has yet to update their V5. Actually the keeper has recently changed their name too which also needs updating on the V5.
