HI i hope someone can help me out i am being harassed by civil enforcement ltd. I parked last year outside my own home but private land and i believe my parking permit had fallen on the floor when i got out of the car. A week or so later i received a parking ticket from civil enforcement demanding £100 to pay them which i ignored on a friends advice. I subsequently received many more letters demanding money from them which i also ignored but today i have received some sort of court claim form which is a bit concerning and i really do not understand iff it is real or another one of there ploys. I would be very great full iff someone could advise me concerning this issue as i do not want to end up in a court. I am attaching a pic of the part of the letter.

CPM or UKCPM ?

Sounds like the surgery got fed up with complaints

If it's UKCPM, they've employed an even worse company

UKCPM, one of the worse companies in the business

Report them to the British Parking Association for the unauthorised use of the logo - possibly Trading Standards as well
The company isn't an AOS member and the false claim is a criminal offence

Hi guys im just to update a very kind person here by the alias of Redvi has meticulously written out a defence for my situation and emailed it to me and i was about to submit it as my defence for the parking claim made by CEL thrugh the MCOL system. I have tried to copy n paste the details into the defence page but they only accept 122 lines and the defence is much longer than that so it wont all fit. They have no option for PDF as i could convert it as a pdf and send it that way but no way of attachment so i am limited in how much of it i can send but it is all relevant. Does anyone have any other ideas as i would prefer to submit this defence electronically rather than by letter. Thanks for reading.

Sorry that was my error the lines in fact do all fit i was adding something extra by accident. Am i able to sign the defence by editing in word or do i need to physically print it off and sign and scan first.

You keep the PDF and you email it to the court. Adding it to the online form destroys the formatting. Hunt around for the email address for MCOL or phone them up and ask. Adobe PDF viewer should allow you to add a signature to the document. Scan your signature and then let the Adobe PDF viewer add it to the doc. A scan using black ink on very white paper gives good results.

Need the case number and description of document in the title of the email.

A few minutes after his last post, the OP emailed me to say that he had reread my instructions for scanning a signature and sending the defence as an attachment

The instructions from Moneyclaim leave the distinct impression that the priority is its own administrative convenience, not the interest of defendants who want to submit a comprehensive defence that addresses all the points of dispute

Perhaps parking "contracts" are unique in requiring longer defences structured like the skins of an onion and the actions of the driver are only one of the layers

Theres nothing for you to do. Standard letter letting you know theyre asking CEL if they wish to continue
CEL will say yes
This then means you will have to fill out a DQ. Your resaerch will have told you what this is. If you dont know by now, go and find out.

NOT jsut DQ

You musst know every step of the process, and when you need to return forms and to where. Missing one can cost you a default judgement

MSE Forum -> parking sub forum -> newbies thread stuck 2 or 3 from the top of the first page -> post 2

BOOK MARK IT. READ IT. MULTIPLE TIMES. smile.gif

RELAX - even if you get a default judgement, if you pay within ONE MONTH the CCJ is wiped.

Yes they do. They get is as far as a hearing date being set and them having to pay a hering fee. They either let it get struck or disocntionue just before the fee is due.

(a) You'd be the first
(b) You'd need to lose
(c ) They can't just add on costs willy nilly, so you wouldn't incur more costs.

Stop
panicking

You clearly havent done resaerch on a) small claims or b) the fact that every single damned tie - EVERY TIME - CEL disctoninue before the hearing fee has to be paid. They have NOT turned up to court yet.

CEL used to turn up to some hearings when numbers were low - but actually lost quite a few anyway!

But they've worked out that by spending a low amount to issue a claim (Around £25) results in many £325's being paid because people are 'scared' of court/CCJ's. They can easily let a few defended ones slip and still be extremely profitable...
