...do as above

At which point you then see if they take it further.
If theyre confident you will get a letter before claim, which you do not ignore.
If theyre not you will get EQuita debt collection letters, which you ignore

There isnt one, if you take the course. Instead you pay for the course.

I just told you not to use the words procedural... as this isnt a council ticket
I didnt say not to appeal
I told you how to appeal
Its not a difficult example to follow. You could search for BOGOFF as well.

No, why would you? Thats language for council tickets, where the term has actual meaning
They just have failed to meet the conditions specified in POFA including but not limited to... and as such you,a s keeper cannot be held liable. You suggest they contact the driver. You are not required to name them, and will not be doing so, and no adverse inference or assumption can be made.

It isnt sharp practice!

The ticket is when the contract STARTS. Regardless of the signs, they are MISLEADING a consumer if they seek to rely on an unknown time of entry when the CONSUMER has a perfectly good start of contract in front of them.

Trite. Settled. No arguments. Law of contract

To rely on an ambiguous unknown start time instead is perverse and wouldnt have a snowballs chance in court.

They are nto the legal occupier of the area. They are merely a leasholder with rights to use that area, but not EXCLUSIVELY for their use. THey cannot further restrict it to others

Sue the stupid idiot. Start at £500 for each incident and work up. Theyll soon stop. Sue them personally

COuld anyone driving it that day have seen?

If the driver (WE DO NOT NEED TO KNOW WHO THAT IS) can confirm there was no notice on the car, then obviously that becomes another part to any future defence

They state a NtD was on there, meaning that they HAD TO wait until day 29 AT THE EARLIEST before sending out a NtK. So DEFINED shortly after

1 day?
14?
28?

Yep thats 92f covered.
damn.

But, as pointed out - they singularly failed to describe the circumstances. Breach of Contract itself does not describe any CONDUCT givnig raise to the charge.

It is trite law that the parking contract starts from when the ticket is bought. Not an unknown time before calculated frmo an unknown point.

It owuld be good to see pictures. Please try to find some of the sighs.

So was there a notice on the vehicle?
Was the Notice to keeper received between 29 and 56 days after?

I didnt ask if there was more communication

I asked specifically about the (f) requirement, which you have marked as OK. This is a commionly messed up area, where they give 28 days, or 29 days from date of issue, or 28 days frmo date of service, etc.

Noone has yet said pay up

Tell the butterfly house to cancel this. Mention the review.
THen you appeal to Parking Eye that theya re require to give a min ten minute grace period. Was it difficult to leave due to it being busy? Any people with protected characteristics there?

Work blocked so cant look at any attachments

Are the signs they state are there, actually there?
Is it jkust a google map with some random dots on it? Anythign showing when it was produced? Anything signed to show it was verified? Or is it just an unattributed map that could have been produced at any time?

The "self ticketing agreement" NORMALLY states that the person signing it IS THE LANDHOLDER

They are not the landholder.

Prove this to the court and they no longe rhave standing. Their entire arrangement is founded on an untruth.

YOUR lease has primacy. No third party can take away from that

I would suggest you then sue the self ticketer for tortious intererference with your lease, trespass against your goods (your car), etc.

Call them and tell them to cancel this outragreous charge for a paying customer
Ask to speak toa manager

Youre not under a huge time pressure given youve already missed their arbitrary 28 day appeal time, so get on with it.

That is complete crap from teh butterfly centre

THEY HIRED PARKING EYE. They are FULLY able to INSTRUCT Parking Eye on matters affecting their custmoers

Pointing out that truthful 1 star trip advisor reviews can result may give you some traction.

Did they give the warnign to keeper, about them being liable 28 days starting the day after the notice is given? Thats usually messed up. Thats (f) above.

"breach of contract" is not a description of the circumstances.

Also, b*****cks to common knowledge
On private land there must be EXPLICIT and OBVIOUS signs barring parking on double yellows. And, as theyre barring parking, theyc annot later say you entered a contract to park there - its a complete nonsense.

Acknowledge the claim ONLINE, do NOT use the paper form.
They dont have to claim a loss, not since 2015. So dont try to understand it.

Just look for current CEL defences - 2018 - and adapt to suit. YES they DO apply.
