How do you file documents with the court?

Hi,

I’m a newbie and I have no idea how to file a document with the court so the judge can consider it.

I have been stung in the past as when I went to court, I brought a document with me and the other side got the judge to basically ignore it because it wasn’t filed with the court?

Can you please help me on how to file documents with the court?

A little bit of an explanation wouldn't be amiss. Normally you would file a defence shortly after you received the claim then a witness statement aout 14 days before the hearing by sending to the court AND the other side.

You can send them by email to the courts as PDF attachments.

Well, you send them to the court - either hand deliver, post, or email. I dont know what is so tricky about that?

Obviously ensure your case ref is on any correspondence, and you must by now know the judges name if you are sending DOCUMENTS to the court allocated to your hearing. If you are only at the defence state you dont send to a court, youre sending to the CCBC which is a processing centre.

Thank you for your replies.

I am being pursued by Gladstones for a private parking charge notice.

I responded that there was no contracts on display at the site. Also that Gladstones did not outline any particulars of claim.

The judge struck out the claim (or so I thought).

Gladstones then sent me another letter with their particulars of claim - and the parking contract they included and stated was at the site was a PDF or a similar document, and NOT the signage at site.

I have now put a response together.

I am still not sure how to lodge my response with the court.

To be clear, I have not been given a court date. I still want to respond to the lies Gladstones are telling in their particulars of claim bundle.

I printed my response off and took it to the court house today, but the counter was closed. They are only open for a couple of hours each day, and I am not normally able to get to the court for that time because of work.

Where can I find the email address for the court to lodge documents?

OK, you've still not managed to give a useful detail

Have you filed an initial defence? Yes / No
What judge, where, "struck out" the claim? Name of place, SPECIFIC info here! (actually, presumably there was an Order that the C provide further and better particulars of claim)

By response, where on the list of following items the court receives do you forsee this response being?
- defence
- witness statement and associated evidence
- skeleton argument and costs schedule

As you can see, there are specific types of document you send

So, in this ORDER you almost certainly got telling Gladstones to file better particulars, did you also not have a part of that order saying you can file an amended defence? And a deadline to do so? Given we havent seen anything, its hard to know, but this would be usual. If so, you SEND THE COURT AN AMENDED DEFENCE! Post, maybe, if you cant find an email address? Thats the only option I gae youve not mentioned.

Or alternatively if there was no chance to file an amended defence, possibly because you missed a deadlinel, possibly because it wasnt Ordered - we dont know, we've seen nothing - then of coruse you will file a witness statement and evidence bundle.

Please, get out your thread, and read the MSE FORUM NEWBIES thread, stuck about 2 down from the top of the first page of the parking subforum. No link, search.
