Hi everyone,
I received a letter in July from London Parking Solutions for parking in a permit only car park “fining” me £100 but reduced to £60 if I pay within 14 days. I looked online and as it was a PCN, I heeded the advice to ignore it. In September, I received a letter from CSB Solicitors telling me it’s gone up to £160! Again, advice online suggested that be ignored so I did this once again. Now I have received a Claim Form from the County Court Business Centre asking for £238.18!! I have gone onto the moneyclaim website and exercised the 28 day period to prepare a defence, which is where I was hoping you good folks might be able to help… I have copies of everything if it’s any help. The car park does display signs but they are not overly prominent. Also, the initial letter just seemed like a scam (as did the second one to be fair), there were no photos of the car parked illegally provided by either London Parking Solutions or CSB Solicitors and now the amount claimed is ridiculous. After investigation of the site in question, there is no meter or barrier or gates to the entrance or anywhere near the car park and no markings on any of the ground either. Spaces are not marked either. Am I able to defend my case on these grounds at all? All comments welcomed! Steve This post has been edited by Cleggy1230: Wed, 1 Nov 2017 - 16:24 |

Good morning everyone,
I have now received the attached through from the court following the submission of my defence. It is offering mediation as my next option. My thinking is that mediation would involve both sides compromising meaning that I would have to pay something which I am now reluctant to do. So any advice would be greatly appreciated. Thank you. |

No to mediation
You should know how to fill this out - this is a well known step. |

**UPDATE**
I have been copied into an email sent by CSB Solicitors today which is withdrawing their case. To say I am chuffed is an understatement so thank you to everyone who contributed to my thread. I would guess that CSB have been passed the defence and decided not to pursue any further. Finally a touch of faith has been restored in the justice system. Winner!!! |

You need confirmation from the court really.

The soliciotrs have attached a signed N279 form. Their email says:
"We act for the claimant on the above matter. Our Client has instructed us to cease any further action on this matter. We attach our Form N279 Notice of discontinuance. The Defendant has been copied in to this email. Our file is now closed." As they are the one pursuing me, are they not the ones in control of this situation? |

Yes, but how does the court know? (You need confirmation they've issued the discontinuance to the court, not to you)

I have been copied into the email addressed to the court. From what you say the court will then hopefully issue conformation themselves...
