Hi, wonder if anyone can give some advice. The other half has had a NIP in the post today and it's addressed to Mr instead of Miss, just wondered form someone who might know, does it fall under incorrectly issued?

We've all heard of Mr Loophole arguing these type of things in court, just wondered if anyone knew anything about this?

Thanks biggrin.gif

It has Christian and Surname correct but title is wrong. There is no title on the V5.

Just a 35 in a 30, probably a speed awareness but wondered if it had been incorrectly issued

If you give Nick Freeman a call he'll give it a go. (I guess your pockets aren’t as deep as David Beckhams)

It's a long shot and risky. It could be argued that a NIP hasn’t been served on the RK.

Given the chance of a course or fixed penalty it may be pragmatic to provide the correct details. Unfortunately there's no automatic invalidation - the matter would go to court. You could wait 14 days from the offence and point out their 'error', they might consider cancelling it out of embarrassment.

I guess their system has defaulted. Is the forename obviously female?

I see no merit in the argument that the incorrect title means the NIP has not been properly served. Sorry.

With the forename and surname correct I think any claim that the NIP was not properly addressed to her would be quite hopeless in court and the police will not drop the matter in advance, so court would be the only way forward. Trying that will lose the chance of doing a course, so not a course of action even Mr Freeman would advise I think. I did see him in action a a few years ago now, he was very good!
