I recieved a NIP ticket on 01/10/18 for doing 37 in a 30 zone on 24/08/18. The date on the letter clearly states it was sent on the 01/10/18.
I’ve read something about a 14 day law in which the NIP must be send out but a little confused if this would apply to me. I am the registered owner and have not changed address. Thanks |

Do you have the V5?
If so dig it out and check your address is correct. Being pedantic there is no such thing as a registered owner, there is however a registered keeper. I take it you weren't stopped at the time? Are you sure you received the letter on the same day it was posted? -------------------- If it looks like a duck, swims like a duck, and quacks like a duck, then it probably is a duck.

I’m 100% sure my address is correct because I’ve never changed address.
I received the NIP on 01/10/18 but the offence was on 24/08/2018 Thanks |

Was this from a camera or were you pulled over? -------------------- Moderator

Ok.
I’m not sure as I’ve spoken to people and there isn’t a camera on the road where it happened as far as most people know around the area. So presuming it was a van checking speeds |

So a camera (which can be static or in a van).
Check that V5c, check the address is 100% correct. Also check the docref date at the bottom of page 2. -------------------- There is no such thing as a law abiding motorist, just those who have been scammed and those yet to be scammed!

There is no such thing as a registered owner.
If it’s on finance they may be the registered keeper, have you actually checked the V5c yet? -------------------- There is no such thing as a law abiding motorist, just those who have been scammed and those yet to be scammed!

OK, sorry sounds like this is a reminder as the timing is about right. The issue you face is convincing a court the original NIP wasn’t received 4 weeks ago.

I may be wrong but this is the original NIP as I know when it’s sent more than once it says COPIED on it? I could be wrong.
Would I benefit from ringing the ticket office or police? |

I may be wrong but this is the original NIP as I know when it’s sent more than once it says COPIED on it? I could be wrong. So you don’t know that then, do you? You could call the office that issued the NIP and ask them whether it’s the first or a reminder - chances are it’s a reminder. Either way, you must reply to it naming the driver. The driver has a defence to the speeding allegation if no NIP was served on the registered keeper within 14 days of the offence, provided no exception applies. -------------------- Moderator

I received a NIP 01/10/18 for going 37 in a 30.
Somebody helped me on her earlier and said because it’s 6 weeks late (not within the 14 day limit) it sounds like it’s a reminder. However I’ve not recieved one previously. Would it say reminder on it?? |

Why start a new thread?
Just add to your previous thread. Reminders don't often say they are a reminder. This post has been edited by peterguk: Wed, 3 Oct 2018 - 21:18 -------------------- |

Just to reiterate - the driver nomination needs to be returned regardless.
You may have a 'late' NIP defence if it truly is the first. That would be unusual but not impossible. Reminders don't always state they are so. Just to be 100% sure, what's the documentation reference date at the bottom of page 2 of your v5. (At the bottom in DD MM YY format) -------------------- RK=Registered Keeper, OP=Original Poster (You!), CoFP=Conditional Offer of Fixed Penalty, NtK=Notice to Keeper, NtD=Notice to Driver
PoFA=Protection of Freedoms Act, SAC=Safety Awareness Course, NIP=Notice of Intended Prosecution, ADR=Alternative Dispute Resolution PPC=Private Parking Company, LBCCC=Letter Before County Court Claim, PII=Personally Identifiable Information, SAR=Subject Access Request Private Parking - remember, they just want your money and will say almost anything to get it. |

Some reminders may have that indicated on them, but most do not. We see that all the time.
