First offence, Wondering what the penalty is likely to be |

Got caught doing 56 in a variable speed limit section set at 40 on the motorway. No points on a licence which has been clean for 24 years. Wondering if anyone has experience of similar and knows what the fine/ban/points are likely to be. I have used the calculator which gives the range but would be good to hear of a real case or two.

Fixed penalty of 3 points £100.

That’s because the calculators refer you to the court sentencing guidelines, as this qualifies for a fixed penalty it won’t be going to court so those guidelines aren’t relevant to you.

Thanks Rookie. Because I had received the notice of intended prosecution and the speed involved put me in to the second band I had assumed I would be getting a higher fine and penalty or even going to court. Your comment will be useful for any first timer in my position of having admitted I was driving and waiting for the next letter.

For a 40 limit the Police guidelines are for a fixed penalty to be offered for up to 65mph. This is an alternative to court.
I doubt it will help other newcomers as we get this exact question at least once a week, in fact there is another example from about 3 days back. -------------------- There is no such thing as a law abiding motorist, just those who have been scammed and those yet to be scammed!

Cheers. Would you agree the likelihood is 3 points and £100? That is what you will receive in the form of a conditional offer of a fixed penalty, accept that and your case will not go to court. If you do not accept it, it will go to court and be dealt with on the paperwork without you having to attend, unless you object to that in which case it will go to a court hearing. -------------------- |

When you accept your offer do not forget to submit your driving licence. Some people do. You won't get a reminder and the matter will be referred to court where you will pay a penalty in the order that you've seen.
