PCN - ULEZ - Incorrect Location

Hi,

We have a fleet pay option for the ULEZ, however we sent a different vehicle to London that doesn't typically go, it happened to be Euro 5 and we knew that we would have to pay the £100 surcharge as its a HGV. Problem was due to an oversight it wasn't added to our fleet autopay option.

So a lovely PCN arrived this morning asking for £1000 or £500 if we pay by 29th October as below.

Looking at the PCN however it has the location down as Borough Road at 10:00. I checked our tracking system and the vehicle was on City Road A501 at this time, in fact it was never south of the Thames at all.

I accept that we were in the wrong due to our admin error but if they have they made an admin error that that cancels this extortionate tax out I think it would be fair dos, any thoughts?

I don't have it. I have the original PCN dated 11-10-19, the request for further evidence letter on the 08-11-19, my postage receipt for 14-11-19, NOR on the 12-12-19 and the latest rejection letter dated 14-1-20.

Then contact the author of the letter and find out where it is, after all it is their 'evidential record'.

Got through to the call center, after explaining to her the part of the letter where it said that it would be sent the lady then stated that the evidential record was sent out rather than telling me from the off. I asked if they had any proof of that and she said no.

The "evidential record" finally arrived.

It consists of the details of the PCN and four lines which basically say thanks for contacting us; they would like to advise no CCTV is issued for the ULEZ, below you can find images (as seen before); any further assistance please contact them.

So to prove the contravention they have to prove that you were in the ULEZ they have pictures that say you were on Borough rd ( I think not reviewed the thread to check location) You say no I wasn't look this is borough road and its not the same place as in the photos. You do not have to explain where you actually were

If TfL say are but its some other road and that's in the ULEZ so got him, then that is not what the PCN alleges

So what happens now, I either pay or leave it and it will go further?

I'm not sure of the process; is there a thread on it? Will I have to do a (phone?) interview with an adjudicator? From another thread on the ULEZ I seen someone reckons TFL and the Adjudicators are in cahoots with each other; so would I be wasting my time?

Have you made representation to TfL ? have they rejected? if so when? post the rejection or

Have you registered an appeal? the content of your last post has me completely baffled

Initial representation was done October, they requested further info on 8th November, I replied, received a NOR 12th Dec ( http://forums.pepipoo.com/index.php?showto...p;#entry1537669 ).

I then had the chance to put in another representation against that through the website which I did before Christmas and they replied on the 14th January referring me back to the NOR and "they took my comments about the PCN being cancelled on-board".

I then requested the evidental record which I received last week which gave no new evidence; there was no video despite the images being taken from what looks to be a CCTV camera.

On the NOR it stated I have 28 days from the day of the letter (12th Dec) to appeal to a road user charging adjudicator at London Tribunals. This deadline has now passed so my confusion is can I still do this? It also says to use a form which I don't seem to have.

I'm not sure what to expect thereafter, do I need to attend, send a lawyer, phone interview or is it written evidence?

You must act quickly, phone London tribunals explain the correspondence timeline and ask if they will accept an appeal out of time, if not pay before it goes up if they will then register an appeal outline why you are appealing out of time and that you will submit further evidence shortly then come back here and let us know what's happening

You will not need a solicitor, you can attend to present evidence or ask that it be decided on the papers your choice
