PCN in Redbridge, Gants Hill Roundabout

Hi Guys,

Just need to check if I am bang-to-rites here.

I parked near gants hill in redbridge roundabout in a pay as you go bay before 8.30am to get some bread from the tesco express.

I went to get a FREE 30 minute ticket, but on the machine, the message came up as that i did not need one as it was before 8.30am.

Came back to the car after a few minutes and it was PCN'd.

Seems to be wrong contravention?
Can't see a loading restriction.

It's bizarre for the payment machine to imply that parking can be paid for from 8:30 when the sign says No waiting from 7:00 to 10:00

There's the additional issue that it's Bus Lane between these times

Also strange that the sign says pay at machine and points away from the one directly under it

Exactly,

Obviously at the time i thought it would be ok as i was only popping in for a second to get bread as i was parked before 8.30am, but from the sign (and correct me if i am wrong) does it mean you are not allowed to park there from 7am- 8.30am? (as from 8.30am you can get a ticket) i am confused?????

Also to note that its the closest and safest place to park when going to that particular tesco express - but the council would give a damn about that point...

I am with Neil on the wrong contravention.

If you consider the three signs in the area with white blocks on the pavement they seem to be very strange.

The first sign has carriageway markings for taxis but the associated sign doesn't mention taxis.

If we go past the parking meter to the next sign it specifies taxis but there is no bay division to denote a taxi area.

The middle sign denotes no waiting and the OP was in that space at the wrong time.

Don't place too much emphasis on the meter it doesn't count as a traffic sign no matter what it displays.

Still wrong contravention.

hmm i see,

So this looks like going all the way to the adjudicator.

So my main argument will be
1. wrong contravention
2. Incorrect/confusing signage?

this is my appeal - please feel free to correct me or suggest any changes.

Dear Council

I am challenging this PCN on grounds of ‘’wrong contravention and Confusing signage’’.

I parked at the location in question to quickly pop in to the Tesco express to get some bread in the morning for breakfast, as it was the safest and quickest place to park to go the tesco express.
As I went to get a FREE ticket from the machine, it came up with a message of that I did not need to have a ticket as it was before 8.30am, and so I went on my merry way.
I was at tescos for easily less than 5 minutes and on my return to the car I was shocked to receive a PCN, especially that it was parked before 8.30am.

Upon further investigation on the signage I feel it is very confusing and misleading for the motorist.

First of all there are no signs to suggest a loading restriction in place.

Secondly the sign is right next to the ticket machine, but has arrows that point away from the machine – why is this?
Also to note that it is strange for the payment machine to suggest that parking can be paid from 8.30am when the sign says NO WAITING from 7am to 10am – So as you can see the sign contradicts the machine – totally confusing.

Based on these points I am kindly requesting that you nullify the PCN please.

Checked today and there is no signage regarding loading or loading.

Looking back at the contravention it says 'PARKED or LOADING UNLOADING...'' on the PCN.

So as it says ''parked'', then am i not bang on rights on this?

they didn't mention anything about the money meter signage in the letter...

is this worth appealing?

It goes on to say 'where waiting and loading unloading restrictions are in force'

Were you in such a place - No - = the alleged contravention did not occur.

The reason why i am not confident is that I just don't think its clear cut.

I've been to adj before and in my experience they want a clear case argument in order to successfully challenge the pcn

i dont think (correct me if i am wrong) that that signage would be enough for an adj to overturn the pcn.

It's as clear as they come: You did not do what you are accused of.

In their reply they say the yellow time plate restricts parking, you parked at restricted time so liable for a PCN to
be issued.
Yes and isn't it a shame for them that they didn't issue one - for that.

The rejection actually helps you, confirming there is not a loading restriction.

Looking at it as you have, re 'parked' = you did, so guilty, is nonsense.

There are over 40 contraventions that mention 'parked' - would they all apply?

It's not the sign there that matters, it's what is not there - no white plate indicating a loading restriction.
