Paid Private parking area, Pass not fully shown

Helping a friend hope this is ok, Got a private car parking bay under ground where she lives access via key fob and
Unfortunately the disc was not displayed correctly but was visible and showing the allocated parking number on it it had slipped down presumably when she shut her door.
She received a pcn on her car window screen £40 charge date 28/12 18 not clearly displaying correct disc
She then filled in appeal on the pcn and sent back to them and said she paid for the bay and the as far as she is concerned the disc was displayed
Never heard anything
On the 12 02 19 sent a parking charge notice (6 weeks later) demanding £100 because not paid the initial £40 charge with a link to the photographs
Also acknowledging the appeal sent, and would let her know the outcome in 28 days
Nothing heard till last week when a letter of claim arrived

Advise on her next move would be appreciated

Is that not the tenancy agreement that you posted earlier? What I was looking for was the right of the landlord to pass on a right to park.

What you've quoted is fine but does the landlord have the right to state this?

Hi thanks for the interest
Wasn’t aware that there was a right to pass on a right to park, misunderstood so yes this is what is in the tendency agreement,
How would we find out if the landlord has the right to pass on the right to park
Do we ask the landowner direct and are they obliged to give information?
We did write to the car-raking company but received nothing back twice!

Ask the landlord directly, if the right to park is something that is theirs to assign.

Can we find this out without asking the landlord as we don’t seem to be getting anywhere with them

Its not a defence "letter" - its a defence, period

Did you include the 5 days for service? Its 33 days, at least, from DATE OF ISSUE

Have you not even STARTED writing a defence?

You can get a copy of the head lease, ut you could jsut go with - my lease says I can park, doesnt require a permit, so no contract needed to be entered.
