I just received today a charge notice apparently from Cardiff Council threatening all sorts of action from full penalty payments of hundreds of pounds to seizing assets etc.
It states that I did not respond to an initial penalty notice - a notice that I never received and have no knowledge of. More interestingly the apparent contravention is dated as 2016 nearly 3 years ago! At first I thought this was a scam - but seems like a legit letter. The letter I received had a last chance offer of over £125 on it however this 14 day period has now expired as the letter was dated start of September and I received it yesterday. I have no knowledge of the incident it refers to and I haven't been to Cardiff for at least 3 years What should I do with this and how should I proceed in replying? The threatening nature of this is concerning me and as I never received anything relating to this previously I don't know how best to deal with this. Im now worried how they will react to this apparent 'non compliance' Can this be legit or applicable nearly 3 years after the fact....?? |

Presumably you were the RK of the vehicle mentioned in the letter on the date mentioned?

So that's £105 then? It's a nasty, disingenous letter; probably unlawful imo, as it implies a warrant will be granted and enforcement agents engaged, at extra cost to you, without mentioning that there is action you can take. So tell us what might have caused you to not receive the PCN and two subsequent notices? -------------------- |

Presumably you were the RK of the vehicle mentioned in the letter on the date mentioned? I was yes - the letter references my correct registration. And would your V5C have been up to date with correct address? Chances of at least 3 letters from council going missing is vanishingly unlikely. Everything up to date my end - not moved address for 3.5 years (although Im hardly ever there).
The whys and wherefores behind items 'vanishing' are immaterial - the fact is this is the first time Im hearing about this incident 2.5 years after it allegedly happened. I certainly had no inkling at the time I had been flashed or booked for anything at all. Are you saying I should have received 3 letters over the last few years from the same department BEFORE this one?? If thats the case then what is the best way to proceed? Obviously Im going to call the council and find out whats happening but certainly don't want to make the situation worse. |

If you're hardly ever there does someone else deal with the post? My name and address on my V5C are all correct. My post is usually left for me by another tenant who has access to the post box. Not aware of any issues of not receiving mail previously. Everything up to date my end - not moved address for 3.5 years (although Im hardly ever there). Will call that number tomorrow and ask for info. All you need to know is as PMB said; has the debt been registered. Then we get it reset. Straightforward. Is it not a good idea to contact the council to discuss this as soon as possible? There's nothing you need from them at the moment. Will hopefully get an update tomorrow! Be patient for phone to be picked up - they will eventually. They will first ask the PCN number. If they have no record of it then the debt is not yet registered. Just repeat it once to check. If still no, tell us and make a note to check again in 10 days. If it has been registered, ask them to e-mail the appropriate form(s) to you and ask your deadline to act.
