I am not the RK of this vehicle. The incident occurred in Atlip Road (the gym in Alperton) the signage is very confusing and the driver thought they were parking on a road with
no yellow line (however apparently this is a private road which is also covered by the signage in the adjacent car park).
Several other cars were also parked and the driver asked the Parking Attendant if parking is allowed.
The parking attendant stated that it was as the driver was accessing the facilities provided by the center. The RK then received the Parking Charge notice.

How should this now be handled? The writer is a total novice and is not aware of the procedures that should be followed.
Should the RK notify that they were not driving at the time?

Many thanks in advance.

Is the PCN, above, addressed to you?

No. It is addressed to the registered keeper of the vehicle.

The REGISTERED KEEPER must write:

Dear sirs,

Ref xxxx VRM xxxxx

I am the Registered Keeper of the above vehicle and have received your above referenced invoice.

Please note that I cannot be held liable as a site visit has revealed that your unremarkable signage, being forbidden in nature, is incapable of forming a contract with the driver. There is, therefore, no cause of action and no possibility of transferring a non-existent liability to me as the Registered Keeper.

I am not obliged to name the driver, and will not be so doing.

I require you to cancel this invoice forthwith. DO NOT contact me further save to confirm cancellation and that you have expunged ALL my details, both vehicle and personal from your records.

Love and kisses.

Thanks Cabbyman. This is extremely helpful. Thank you. I will copy your letter template. A few questions:

1. Should I sign the letter and state Mr X at the end (i.e. the registered Keeper name)
2. My understanding was that the Registered Keeper is liable irrespective of who the driver was?
3. I have just realised someone else received a PCN at exactly same location as me: http://forums.pepipoo.com/lofiversion/index.php/t121055.html - the view is that the letter should be sent by certificate of posting only. However the notice states I should use there online form. Is that ok if I send via post?

1. No! RK must sign and send.

2. RK is liable IF they comply fuilly with PoFA, in every respect.

3. Appeal online, as per their instructions, but keep a screenshot and, if possible, a photo before it is sent. Make sure any default drop down boxes saying driver are changed to keeper.

It is VERY important that this is done in the name of the RK, NO OTHER person.

Hi All,

The RK received the following letter in response to the above. How should this now be responded too?

Any grounds / thoughts on how to proceed from here?

Here is the sign. The sign is in the car park and not on the road into the car park. Any grounds? Can I just ignore it?

Over the weekene,d how many other threads did you read?
None?
Ten?
Twenty?

How close is post 4 to being the truth? do you understand "forbidding" and why its important? If not, have you done any obvious searches to find the explanations?

Hi nosferatu1001, Apologies for bumping the thread. I am just getting a bit panicked with the whole thing. Appreciate I am not an experienced user in this forum.

Post 4 is correct. The letter was sent to the RK. I am not aware on Forbidding. Apologies in advance.

Thats not what I asked

I asked how many threads have you read. Because you cannot just sit, passively, and have it haneded on a plate. You have to do some work yourself!

I asked - now you KNOW or can FIND OUT what is meant by forbidding, you need to answer whether the signs ARe forbidding. If they ARE then post 4 appeal should be used.

I have read many threads. Not all are relevant to my case and to be frank I did not want to comment on this earlier as I felt that it distracted from the purpose of this thread. Clearly you do which while might be good for writing and attacking others it adds zero to this conversation. I do not expect to be handed things on the plate albeit I did think this forum was for helping others. If you do not wish to help you do not need to reply. Quite simple really.

On the question of Forbidding - thanks for your helpful response. I don't understand it really so given no insight provided I shall seek to get guidance from someone who may be willing help. Kind regards.

Here's some help - Top right hand corner is a box. Type in "forbidding signs" and hit the button that says search. Scroll down and look through the Pepipoo results.

Alternatively you could just read some of the other topics on this front page - one of which is a success result posted today. Reason for the win - forbidding signs.

This thread might help. The info appeared about 11:30, an hour before you added you comment, and would have been high on the list of threads
