FightBack Forums _ The Flame Pit _ Road Debris From Car Accident

Hello,

So I was driving along and noticed a small accident up ahead. The cars involved already pulled to the side of the road and were talking / swapping details etc. I then noticed a small piece of debris on the road which looked like it may have come off one of the cars.

I drove over a piece of debris and maybe cracked / damaged whatever it was as I was unable to move around it quick enough (it was a 3 lane roundabout and didn’t have time to check the other lanes and swerve around it as I was already driving around it.

My question is: should I have stopped?

I didn’t think I had to as I was not part of the accident but drove over some of the debris but wanted some advice from others?

Cheers

No need to stop at all, you were not involved in the collision.

Why did you think you had to stop?

In theory it could be argued that if damage was caused to whatever you drove over, this was a separate accident, but we can fairly say this is where the de-minimis rule would kick in (i.e. the law isn't bothered about petty bollocks like that).

It's funny you say that - My tyre had some damage when I checked it - initially friends were telling me to claim for damages but im not going to. To be fair, Im not even sure of whatever was in the road was even from the accident . i just assumed it would be.

Who from?

Even you could identify the drivers, you don't know which one was more responsible

He was going into the very very petty side of things, but just like the example that "cp8759" gave, it would be extremely petty and the law wouldn't probably care. (probably just get laughed at)

Does anyone else have any views about stopping or not?

Yes - you’re being daft.

I think that is your answer.
