hi everyone,
So I received a fine under the contravention code 62: parked with one or
More wheels on or over a footpath or any part of a road other than a carriageway.
When I went on the London borough of Barking and Dagenham to pay, I clicked on the evidence section, and there is no photographs taken. Is it possible to beat this penalty charge? If so how could I beat this?

Put pics on https://imgbb.com or such like.

There will be pics taken by the CEO but you may have to ask for them.

Photographs are not required by the legislation but, if this reaches appeal at the tribunal, an adjudicator may deduce what they will from their absence. If you see what I mean!

As already advised, post up the docs.

Your PCN is issued under the English civil law, and is not a matter for a court, the final point in the process is adjudication, where the matter is decided on "the balance of probabilities". Photographs are not a legal requirement, it is a matter of your word against the CEO's. However, it is now normal for photos to be taken, and these are normally obtainable on the council website on quotation of the PCN Number.

So if you could do as DD requests, better advice can be given. Parking off-carriageway has been an offence in London since the 70s. Also if you take the matter to adjudication, it will be for the full PCN penalty, the discount option has been lost by then.
