PCN Woolwich - Not parked within marked bay

I received a PCN on 25th February which I appealed. I received a response from Greenwich council on 11th June stating that the Council 'was satisfied that the Penalty Charge Notice has been correctly issued and payment of the charge is due.' The payment at this time was £30 however by the time I had come back from holiday the full amount of £60 was due. I decided to wait for the Notice of Owner to come through, as I still do not believe that the PCN was issued on correct grounds.

Please see my letter that I propose to send back to the council in response to their most recent letter. I would appreciate any help or input with the below:


RE: PCN GR*******

I am writing to formally challenge the Notice to Owner received on 10th July 2018. This is in correlation to the Penalty Charge Notice issued on Sunday 25th February at Powis Street car park.

The PCN was dispensed on the grounds that LY** *** was not 'not parked correctly within the markings of a bay or space.’ My vehicle was parked close to adjacent cars and was not obstructing any other vehicles. I also ensured that there was an abundance of space for other cars to manoeuvre around. I received the PCN on Sunday 25th February . My challenge is on the basis that parking is only controlled in this area Monday - Saturday 8am - 6:30 pm, therefore there are no restrictions for parking of any description on Sundays. Consequently parking controls within this area were redundant when PCN GR****** was issued.

Enclosed within your letter dated 11th June 2018, were two photographs of my car and one photograph of the pay and display machine and adjoining signage. ‘Park within marked bays only’ has been highlighted in orange on the photograph. However the first line on this sign reads ‘This car park operates a PAY & DISPLAY system’. Therefore one would assume that any parking rules are to be adhered to only when the pay and display system is in place, which as stated on the right hand side of the sign, is Monday – Saturday 8 am-6:30 pm. Furthermore if ‘park within marked bays only’ is policed seven days a week, twenty four hours a day, then the signage that is currently in place is exceedingly misleading and needs to be updated immediately to indicate otherwise. I have parked frequently in Powis Street car park so I am aware that many other drivers leave their cars from Saturday evening 6:30 pm – Monday morning 8 am, within both marked bays and unallocated spots. Therefore I am sure that other drivers have fallen prey to frivolous ticket inspectors issuing PCNs on these grounds.

For these reasons I look forward to receiving notification that the Penalty Charge Notice has been cancelled. Should the PCN not be cancelled, I will have no hesitation in requesting the PPO for Powis Street car park and taking my appeal to the Independent Adjudicator.

As usual, for best advice please post up here all sides of the PCN and GSV(Google Street View ) link to the location, together with copies (not transcripts) of what you wrote and of their repliy..

Try this:

Do not attach docs/photos, but use this method:

for how to do it. I use Tinypic for stage 2 with no problems. Thera are other sites, such as Flickr (where the BBcodes are concealed behind the curly arrow (click on it) for sharing), which enable you to paste the BBCodes into your post here.
STAGE 1 takes care of resizing. If you use Tinypic for Stage 2, on the left each image in Tinypic is a list of links. Highlight and copy the entire link 'for forums' from the list for each image - beginning with IMG and ending /IMG (include all the square brackets [ ] ), and paste each link into your post. Each copied and pasted link will embed a thumbnail link in your post.

Using the attachment method is not advised as it means quickly running out of attachment space.

Redact/obscure name, address, PCN number and reg.mark.
LEAVE IN all dates/times; precise location, Contravention code and description.
