Worried about missing summons, Totting up

Hi all,

New to this site but glad to have found it.

Long story short, I’ve been struggling with depression for ages and have neglected my life organisey stuff, including updating my driving licence address.

Anyway, a few months ago I was hit for speeding which took me to 12 points. Currently my online licence record shows 9 points but I have paid the fines for the convictions taking me to 12. Ive been assuming that I’ll receive a summons for the final 3 taking me to 12, and getting a totting up ban. I received a dvla request asking if I had changed addresses which I returned saying yes. My car has always been registered to the correct address, I’m just behind for licence address.

It occurred to me today that I haven’t heard anything yet and it’s been a few months. I’ve become worried that the summons went to the old address on my licence and that I might have missed the court date. I’m worried about the implications of this - whether I might get arrested or whether the sentence will be harsher. I did receive notices for the individual convictions at my correct address, presumably because the car is registered here.

I called the dvla who said they couldn’t advise on the summons and directed me to update licence online, which I’ve done.

Can anyone advise?

Your DL has nothing to do with speeding paperwork.

Your V5C is what matters.

So you received a NIP? Named yourself as the driver and returned it?

It is normal for SJPNs (new type of summons) to be issued close to 6 months after offence.

I did receive notice but cos of my depression I’ve not been great at opening mail in good time. So I didn’t return anything. I did pay the fine that I was eventually issued from the court.

So it will go to the address on my v5c?

What fine? What court? How much did you pay?

You must have received other paperwork in addition to the original NIP which you did not reply to.

Ok so basically this time last year I had six points. I was flashed in June which is an incident I know of. When going through some old mail I came upon a speeding notice that I didn’t know anything about (can’t remember being flashed) and it was dated April. At the time I spoke to court fines enforcement who confirmed I had two outstanding fines - one for 305 and one for 335. The guy explained the new fine algorithm. I paid one immediately and cleared the second one just before Xmas. I’m still unsure about the April one but I imagine it’s too late. It’s very possible I’ve overlooked some other papers, like you suggest. That’s part of my worry - that I’m not 100% sure of what exactly I’m dealing with.

The conviction from April appears on my online record but the June one doesn’t.

I think I remember returning a reply for the June one but not the April one.

Court was local magistrates

I think, with respect, you need to ask the court for the full details.

If the court has convicted you for two endorseable offences they would already let the DVLA know.

So either

1. You are confused about dates and there is overlap.
2. One of the offences wasn't endorseable.
3. The courts and/or the DVLA have messed up.
4. We haven't got the full story because you only know two numbers and some letters which you may or may not have opened.

More information = better advice.

Thanks mate. That’s been my conclusion too. Just anxious about how much **** I’ve got myself in because of doing an ostrich. The plan is to contact the courts for where the car is registered and where my licence is registered (when they open on Monday), asking for the relevant info. The lack of the anticipated summons just unsettled me earlier when I realised it might be the case and there may be repercussions.

The court used for a speeding offence is local to where the offence occurred.

The court used for a failing to provide driver's details is local to the police office where the reply should have been sent to.

Licence and registered keeper addresses are not relevant to court selection.
