Good evening all
I received an email last week from my company’s fleet manager. Said email contained contents from the police of an intent to prosecute over a speeding offence along with a PCN number date and time. The date was 26th April at 07.06am. I am yet to receive a letter with any more details on so my question is this: Where do I stand with the amount of time I have to pay the fine following the speeding incident? I was driving the vehicle as I was in my van on that day so not denying it was me driving, but I am worried that a few weeks have elapsed since. So I don’t want to be even more out of pocket if I can help it or face further prosecution for not paying. Also I would like to know what the eligibility criteria is now for speed awareness courses? My van is limited to 67mph and the road number they have given is dual carriageway up until it’s a 50limit before the next town. I’m assuming it’s there I was flashed but don’t know speed or exact location until I receive further details. Thanks for your help Banana |

They key issue is, has the fleet manager replied to the police and nominated you as the driver? Once he does, the police will send you your own NIP and you deal with that one.

Yes they’ve replied to the police and sent them my details with my permission.
Does that mean that I still have a certain amount of time to reply to the NIP or does the time start again once they send me the NIP? Thanks for your help. Or at least they told me they were going to put in a request to transfer liability?! |

Once you receive your own NIP/s172 request you will have 28 days to respond.
A course is usually offered up to 64mph. -------------------- RK=Registered Keeper, OP=Original Poster (You!), CoFP=Conditional Offer of Fixed Penalty, NtK=Notice to Keeper, NtD=Notice to Driver
PoFA=Protection of Freedoms Act, SAC=Safety Awareness Course, NIP=Notice of Intended Prosecution, ADR=Alternative Dispute Resolution PPC=Private Parking Company, LBCCC=Letter Before County Court Claim, PII=Personally Identifiable Information, SAR=Subject Access Request Private Parking - remember, they just want your money and will say almost anything to get it. |

Yes they’ve replied to the police and sent them my details with my permission. For information they don't need your permission. They have an obligation under Section 172 of the Road Traffic Act to provide the driver's details. They face prosecution if they fail to do so. |

they told me they were going to put in a request to transfer liability?! "transfer of liability" is for council PCNs. NIPs are totally different and involve no liability to transfer. -------------------- |

Ok so I’ve requested the tracker details from my employer. At the time of offence I was doing 66.5mph and from what I’ve managed to work out it looks like the camera was parked at the start of the 50mph limit. AT 07.06am in the morning!! Grrr.
Haven’t had details from police yet to compare the speed. Any idea what I’m looking at if the details are the same as tracker? Thanks |

A fixed penalty of 3 points and £100.

This is what I received in the email from employer...obviously I've removed the number PCN Number Date of Offence 26 April 2018 07:06 AM Issuing Authority West Mercia Police Cost 0.00 Location A449 Notice Type Notice of Intended Prosecution Fine Type Speeding I would attach a screen shot of the email contents but cant work out how to attach it. |

We don't need you to post anything, this is all irrelevant. There is nothing for you to do until you get your own letter from the police.

I haven't been through this before so I am just curious as to what the procedure is and what if anything I have to do. But thanks anyway for the help or lack of A fixed penalty of 3 points and £100. Have the fines not changed recently? I vaguely remember something in the news a while ago about percentage of a weeks wages. |

But thanks anyway for the help or lack of We've told you there is no need to do anything at this stage, not sure what else you except us to say. I can only speculate that most of the emails your fleet manager sends are for PCNs rather than NIPs, so maybe he didn't adjust the email template. Have the fines not changed recently? I vaguely remember something in the news a while ago about percentage of a weeks wages.
