Hi,
The driver received a PCN on 12/02/19 while attending an appointment at the West Middlesex Hospital. After driving around the carpark, there was no parking available. The bay failed to provide adequate spaces therefore he/she did park outside marked bays (that area does not have any markings on the road/ nearby which indicate you can't park) ensuring that the driver did not impede any of the current/future occupants from entering/exiting the park or any bays. It was also a barrier parking area, so at the time the driver couldnt leave without paying, despite not using the parking bays. On his/her return (in an hour time) driver had a PCN attached to the windscreen - for ‘Parked in a roadway' Please note that the driver already paid the parking fee for the hour the car was parked. The driver went next day to see the board and found a different one facing the other side which couldn't be read as it's too high and in small prints. Amend your post now so you refer only to "the driver". You are the keeper, and it's important not to reveal the drivers identity.
Can you post up the PCN with identifying details redacted. |

So a complaint is made to PALS at the hospital
The keeper appeals to UKPC so that the appeal arrives on day 26 (of the 28 days allowed). Complain about lack of clear signage, money paid, etc. Give the keepers name and address but change the address slightly so that it is slightly different to the V5 details, not sufficient to stop delivery of a response. The aim is to get a response to the keeper without applying to the DVLA for keeper details or not issue a Notice to Keeper. Bot are failures under POFA and if no NTK after 56 days then cannot claim from the keeper. |

Thanks for your response. Are you suggesting that both complaint should be made to pals and an appeal made on the 26th day to ukpc. If the appeal has to be made on 26th day, does it mean that the fine payable (if appeal rejected) is £100 or does the driver/keeper still have 2 days to pay? |

Pursue the hospital (PALS) ASAP...

You should also ask the hospital for a copy of it's parking policy, they are required to make it available but almost none of them do.

Hi all,
Thank you for all your help and suggestions. I did contact pals but they say it's nothing to do with them. Hence now the keeper will go through appeal process in due time. |

Tell them that WM hospital is responsible for its own parking agents. they can cancel it You got fobbed off FAR too easily there. |

Why should you do it? It's their agent. Go back and tell them you don't wish to waste time on something that they can easily sort out with one E mail, failing which you will be invoicing them for your time in sorting out THEIR non-compliance with government guidelines.
However, keep your eye on UKPCs' deadlines in case you do need to go to them with your appeal to arrive on day 26. -------------------- Cabbyman 11 PPCs 0

I suspect they are on an arrangement whereby they pay a fee if they want to cancel, and want to see if they can avoid it?
