Parked in a special enforcement area, Parking Ticket

Hi All, hope you can help.

I got a ticket today for a rule/law/violation of section 26, parking in a special enforcement area more than 50cm away or other specified distance from the edge of the carriageway and not within a dedicated parking space.

There is no signage or yellow lines, the road has double yellows but not across the bay, however that in this instant it related to the dropped kerb which requires no signage.

Now I feel I have parked well back and not blocked the "the path". Next to where I am is the kerb and then a scrubby muddy area with a fee bushes.

I'm not sure on this one, to me I am well back from where the kerb drops which to my mind is the bobbled, lightetr paving. As the kerb curves it raises although only a little although the mud etc makes it difficult to see.

Am I bang to rights here or do I have any grounds of appeal?

The pics I have taken are to large to upload here but happy to send in another format if anyone can help or I welcome any advice as to how I might upload here.....

So quick response. They have cancelled the ticket but with the following reply.

What does everyone make of the response

Good Morning

Thank you for your email appeal for Penalty Charge Notice MK39921613.

We are pleased to confirm that, on this occasion only, the Penalty Charge Notice (PCN) issued to your vehicle has been cancelled. However, your vehicle was parked outside of a marked parking space on an access road.
 
Central Milton Keynes (CMK) is covered by a Zonal Traffic Regulation Order that means that all vehicles must be parked within a marked space, as this is a Zonal order this is signed at entrance and exit points to CMK,.

We do think it is clear that you should not be parked here, and the fact that drivers tend not to pay when parked in this area implies that they consider they have discovered a 'loop-hole'.

However, as a gesture of goodwill we will cancel this Penalty Charge Notice although please do not continue to park here as further Penalty Charge Notices will be enforced.

Well done, they got the message then.

Wrong contravention for parking outside of marked bays, simples.
But is what they have tried to pull before with Parked more then 50cm..... muppets.

Whether there are signs or indeed the zonal TRO is anyone's guess but is a big zone so unless some repeaters, lack of adequate signage is against them on that one.
Still can't work out why they didn't use the DYLs ??
That would make me wary of parking there again but if you did try for the highway terrier it may explain.
