A driver parked a car with a disabled occupant with a valid blue badge, in a free car park disabled bay at a shopping center. But forgot to display their badges, and unfortunately got a PNC asking for £80 or if paid within 14 days £45.

Where do they stand with this?

Parking company I presume are private, Horizon Parking.co.uk

Thanks

Change your sentence to:

The prominent large sign says 'disabled badge holders only.' I understand one of the occupants of the vehicle was a disabled badge holder and, therefore, is entitled to reasonable adjustment in accordance with the Equality Act 2010.

IF they don't cancel, their refusal will contain a POPLA code. At that point, you tailor the standard 4000+ word POPLA appeal to your situation and they should be instructed to cancel it by POPLA.

What are you scared of?

Yes looks OK to me.

But don't for one moment expect them to cancel the PCN. You've entered a game which will require perseverance on your part to bat away all the subsequent paperwork. The object being to convince them that you're not a soft touch and they calculate that the odds are in your favour should it come to court.

If you're not happy to see this through over the coming months and are uncomfortable with this whole process, then in all honesty and for your peace of mind you'd be better advised to just pay up now. On the other hand if you're up for a fight then accept the guidance that you're given here and take it forward.

Hex, this should win at POPLA. Court won't come into it.

I don't disagree. That is entirely possible.
I was just trying to forewarn in the event this were to be rejected at POPLA.

Ok so reading the back of the PCN it asks for name and address of driver/owner of vehicle. I presume I do not give these,

It also asks for supporting evidence, I presume this will be the blue badge, do I send a copy of this minus itentifiying numbers/name...etc?

Correct, there is no legal requirement and loses you a potential line of defence.

They are going to reject so just copy it minus identifying marks.

You are only appealing to get the POPLA code, be under no illusion these are normal people working to fair rules, they are the opposite.
