I have today been issued with a ticket for parking in a bay that is for the disabled
Now both myself and my wife are disabled and so parked outside of tesco in Broughton. We I got my wife into her wheel chair she passed me the badge to display which was placed in the windscreen. I then took her into the shop to use their facilities. On return we had been issued with a ticket for displaying an out of date badge, which on checking it was ,as my in date badge was still in the door pocket. My Vehicle is registered as having a current blue badge , I am registered with the DVLA Will this be enough to show it was a genuine mistake that my previous badge was placed in view by mistake. Do I have any grounds not to pay the £100 they are asking for, The company are called Park Watch of Chester Both being disabled this is money we simply do not have. Yes I had placed my old badge on display by mistake but the current one was in the vehicle and this was a private owned car park not council Can I just not pay as it's a private car park or do I have to find a way of paying this fine. Thank you |

First step is to go back to the store and demand that the manager cancels it
The chances that Park Watch will go near a court with this are next to zero Tesco contracts with its parking companies don't let them take legal action |

Tesco just happen to be on the out of town park along with many other companies. I hold my hands up I displayed the out of date badge which I should have removed from the door pocket where I had my new one stored. Don't know if it's worth trying to call Park Watch tomorrow and try to argue my case but I feel it will fall on deaf ears. |

Pursue Tesco in the first instance. The parking company just want your cash and will happily take it.

Thank you so much for the advice, feel stupid that it happend and i have to look to you for help.
And I am sorry if I question anything but I struggle to deal with understanding alot of the info that has been given My own disabilities sorry. So i don't phone them , and ignore them , but I don't understand how I change my address to stop them Very sorry if you have explained this already. |

Try Tesco first, but I suspect they won't be helpful. Their preferred car parking firm are Highview, not Park Watch. Should the approach not be successful, I suggest you contact the retail park manager, who is more likely to be the contracting organisation bringing in PW to harass customers.

As stated if you can return to the store and speak to the MANAGER only, not the customer services. They may fob you off.
Take both blue badges with you and state that this is causing you great stress. |

You need to let them know that they have to make reasonable adjustments under the equality act as you both have protected characteristics. You clearly should be parking in those bays.

Thank you to all that have given me information
to guide me. I emailed the shopping centre manager explaining what had happened He has replied basically telling me I was in the wrong and the company employed to monitor the car park have treated me fairly. But as a goodwill gesture he will contact them to try to over turn the decision. I wont hold my breath but I'd like to thank you all for offering your advice. |

You should remind him of his obligations under the equality act, anyone with protected characteristics has to have reasonable accommodations whether you have a blue badge and whether you display it or not, its not optional.

That response potentially puts him in breach of the Equality Act. I wonder if he realises that.

For the purpose of advising others who might fall foul of the roving parking attendant at Broughton, who actually ordered the cancellation of the parking charge please?
