Hi good people,
I received a NIP today from west yorkshire police for doing 48pmh on a 40pmh speed limit road. This was captured on a manned device. I dont have any recollection of this alleged offence. The video evidence on their website isnt clear either. Does anyone think I have a chance if I challenge it? Thanks |

You cannot challenge a NIP. It's simply a notice, and you've been notified.
When you've replied naming yourself as the driver, you will be offered a speed awareness course and/or a fixed penalty, if you are eligible. If you do not accept either, you will (eventually) have your opportunity to challenge the allegation in court. As for "Does anyone think I have a chance ...?" - none whatever, unless you have some defence you haven't told us about. |

Were you driving at or near the location stated on the NIP at the stated time? If you know you definitely were NOT in the area at the time, then you have a defence (it could be a plate mis-read, for example).
If you are the registered keeper of the vehicle, did the NIP arrive within 14 days after the date of the alleged offence? If you are, and it didn't, then you may also have a defence (albeit one that's hard to prove). |

Any reason you didn't complete the NIP wizard as linked to the 'Read this BEFORE posting' sticky? If you did we may be able to look for something to help you, a description of events is kind of useful if you want us to help you look for defences as my crystal ball is in for it's annual service right now.

Thanks all for your response. I was the one driving the car and the registered keeper. The area I am contemplating on is the video evidence. It isnt clear at all. Should share a link of the video from my private YouTube video (YT channel not my real name)?

It isnt clear at all. It seems clear enough to be able for them to read your plate. Anything they make available to you now may not be the full evidential quality. -------------------- RK=Registered Keeper, OP=Original Poster (You!), CoFP=Conditional Offer of Fixed Penalty, NtK=Notice to Keeper, NtD=Notice to Driver

It shows 48mph for less than 2 seconds, then 28mph, 34mph, 33mph, 36mph and 35mph all within 15 seconds. There were several cars passing the front of the camera as well. It is not clear which car they have captured, whether it was actually my car and how accurate the capture was. See link is below.

Link doesn't work, the video is marked as private. You'll need to mark it 'unlisted'

Nothing obvious, looks like a solid capture.

Looks like a good ping to me.
They were on the opposite side of the carriageway - the cars receding have a negative speed reading whereas yours is positive (approaching). -------------------- RK=Registered Keeper, OP=Original Poster (You!), CoFP=Conditional Offer of Fixed Penalty, NtK=Notice to Keeper, NtD=Notice to Driver

I'm pretty sure they nicked the red Jag!! its the red jag. Do you think there is any ground to challenge them based on the video evidence?Crosshairs are bang on. Nope. Do the crap course (which others feel is good!) if you can spare 4 hours or pay the £100 and live with 3 points. |
