I am trying to build a library of all the PePiPoo cases that have had happy endings, be it written confirmation or timed out.

Can all users post the link to their (or any other cases they know about) threads so a database can be made up. Once I have a list I will edit this post and update it as and when required.

Not that we get them that often, but when the trolls appear on the site and start having a go, it would be nice to point them in the direction of people who have "had a go" and came out unscathed.

Another cock up down under.

As usual there is no thread for this as it relates to New Zealand law - but the good news is I won again!

The facts.

Stopped on 1st November 2008 and given a ticket for doing 112k in a 100k zone.
In NZ you have to "request a court hearing" to avoid the ticket being lodged in the court as an unpaid fine.
A hearing was requested exactly as the police paperwork states, unfortunately (for the police) their paperwork had already been declared "completely wrong" by a High Court judge (a previous case of mine) a few months before.

Hence I was sent a Notice of Fine by the court. So I waited, and waited, and waited, for it to be chased up.

Which it was by a court bailiff visiting in March 2010, and my wife thought she was being helpful by paying it (fifty quid).

I then have to file relevant paperwork swearing that I asked for hearing and didn't get one. The whole system (finally) goes into reverse....money refunded and court date set for today 2nd July.

I'm the first case on. Police withdraw by leave of the court - and then an arguement ensues about costs. And a letter is produced purportedly sent to me a month ago, by the police telling me the case was going to be dropped. However this letter has the wrong address, and I've never seen it before. NZ postal arrangments are a bit strange and letters will not get delivered to me unless the address contains certain key information. This one didn't, and I've no idea where the police got the wrong address from - even the postcode is incorrect.

Anyway, I knew I would never get any costs but I have to ask so I can now appeal (again) to the High Court - fully prepared with Rookes v Barnard and "outrageous behaviour by servants of the government". Whatever the outcome the police will have to pay for the crown solicitors to represent and argue why I shouldn't get costs and punitive damages.

I'll keep you posted.

Letter to SCP bringing this to their attention resulted in a letter to the OP advising further action.

Allegation of using a motor vehicle without insurance when pushing / rolling a child's quad bike on a footway.

Magistrates found that the bike was not a 'motor vehicle' therefore insurance not required.

Couple more success stories from down under - this is turning into a habit.

Another one bites the dust, police fail again.
Or more accurately, another two police prosecutions against me fail.

Getting on for a year ago I was accused of "theft of a wheel clamp", fitted to a car at the university. Yesterday the farce finally came to an end, case dismissed. And the Police even cocked that up by forgetting to tell my lawyer over a month ago that the case was going to be withdrawn.
So a big thank you to all taxpayers as it was all on legal aid - the final bill, including a search warrant executed at my house looking for a wheel clamp in bedroom drawers, must be in five figures - now it's off to Police Complaints.

Part 2. Just had an e mail from the Police in Rangiora which contains this gem:

"Due to an administrative oversight the certificate of accuracy for the vehicle used in the weekly 'run through' was not disclosed.


Police accept that in fairness to you and in the interests of justice the charge against you should be withdrawn."

Do I detect the smell of bullshit?
