Received a PCN at Fistral. Had tried to purchase a ticket by mobile. It recognised our other car's registration so tried to change that but was left waiting on the phone for 5 minutes. Assumed something was wrong so rang back and message said your parking will expire at 1.30pm. Rang again and got the same message so assumed was ok. Then received PCN. Checked bank statement and money wasn't taken from account. Appealed but they said "as shown on car park signs, it's the motorists responsibility to purchase a ticket for their full correct vehicle registration mark". We had tried, and thought had succeeded, to purchase a ticket and the fault is with the mobile purchase of the ticket. Only proof we have is the mobile phone log with calls to Smart Parking and duration. Is it worth appealing through POPLA as this is only proof we have? Many thanks.

Did you admit to driving?
If not it’s 100% winnable at POPLA, otherwise they are not litigious so can be ignored. POPLA will agree the PCN was correctly issued regardless of the circumstances. -------------------- RK=Registered Keeper, OP=Original Poster (You!), CoFP=Conditional Offer of Fixed Penalty, NtK=Notice to Keeper, NtD=Notice to Driver

Smart Parking are 100% beatable at POPLA, if a registered keeper has appealed and NOT implied who actually parked.
I hope you didn't blow that winning position at first appeal by talking about who did what and why? Actually said who was driving, eeek? QUOTE Only proof we have is the mobile phone log Send a SAR to the phone parking firm (Ringgo?) for proof of payment made and how long the duration parked was. Give your phone number, VRN and your name & address and send a SAR to get their data. I wonder if the wrong VRN was used, wrong car. Either way you won't be PAYING Smart Parking !
