Hi all, I think I've read all the stickies/'how to' posts but please flag up anything I've missed. I am not the RK of this vehicle. The signage around this road is very confusing and the driver thought they were parking on a road with no yellow line. Several other cars where also parked. The driver doesn't understand the reason for the ticket – Reason One: aren't all roads access roads of one type or another!? Reason Two: there aren't any marked bays along that stretch of road. The RK is elderly and is now very worried and wants to pay up. Can't let her do this without getting some advice from you all first so please help! Thanks, Frazzled This post has been edited by Frazzled: Thu, 21 Jun 2018 - 10:34 |

I forgot to add that there are double yellow lines on the opposite side of the road and that the total observed time was 15 minutes.
Also, it says I have 14 days to pay the reduced rate but 21 days to make an appeal. Doesn't that hinder my right to pay the reduced amount? |

Literally EVERY thread stated you do NOT identify the driver! You should know this as youve been here since 2012.
You dont have any "right" to pay the lower amount. Its a bribe to get you to panic and just pay. |

You dont have any "right" to pay the lower amount. ...other than what the Code of Practice from the relevant ATA states. -------------------- RK=Registered Keeper, OP=Original Poster (You!), CoFP=Conditional Offer of Fixed Penalty, NtK=Notice to Keeper, NtD=Notice to Driver
PoFA=Protection of Freedoms Act, SAC=Safety Awareness Course, NIP=Notice of Intended Prosecution, ADR=Alternative Dispute Resolution PPC=Private Parking Company, LBCCC=Letter Before County Court Claim, PII=Personally Identifiable Information, SAR=Subject Access Request Private Parking - remember, they just want your money and will say almost anything to get it. |

Its a bribe to get you to panic and just pay. Thanks for that and yes, I have been here since 2012 when I had one council PCN, but that certainly doesn't make me an expert! I have had no contact with the company yet, so haven't identified the driver and nor will I. This is my first PPC ticket and therefore, am looking for advice just like anyone else. However, the elderly person is applying their own pressure as she's scared about what might happen if we we don't pay. So, are you saying 'just ignore'? I've read through most of the 'ignore it or not' sticky and still feel confused! |

They are extremely litigious -not recommended to ignore.
But the pictures show the car in a marked bay? -------------------- RK=Registered Keeper, OP=Original Poster (You!), CoFP=Conditional Offer of Fixed Penalty, NtK=Notice to Keeper, NtD=Notice to Driver

The car in the last photo isn't mine but shows no yellow line on the road. I think you may be referring to the photo above that, which shows the sign on the street. The same sign appears in the car park too. Any advice about what to include in my appeal? |

You have been told to EDIT YOUR POSTS.
Do not identify the driver, whcih on this PUBLIC forum, you HAVE done. Call them THE DRIVER Final warning, else I am out. There was literally no way to get "ignore" from my post. You MUST NOT jump to conclusions. |

Also, I just asked a question about ignoring and certainly didn't jump to any conclusions. |

OK, fourth pic down is the sign on the street and it's the same ones as for the car park. There are no other signs around.
The last pic is the place where the car was parked showing no yellow lines. |

The sign isn't far and yes, the driver believes there is an offer to park.
The sign says, 'customers of the Atlip Centre must log their registration into the permit system inside' and this was done. As the driver was a customer of the centre, the rest of the sign didn't appear applicable. |

The drivers beliefs are irrleevant
Do they OFFER or do they FORBID? OK so there is no breach of the sign terms? |

My understanding of the sign is that there is an offer. But like I said, the sign is confusing!

The there is no offer there! Look at the PCN ''no parking'' on access road. Parking is forbidden on that road.
But she will be sued so...would it matter if she got a CCJ, say at your home address? Honest question, would it matter to her? |

Honest question, would it matter to her? The driver had no idea it was an access road before parking up as the signs in the images are the only one along that stretch of road. The driver only realised it was an access road when reading the PCN. If someone else (me) could handle this for her and represent her, then no. But will a CCJ result in paying excessive charges than they are currently demanding? Do we even stand a chance of having a positive outcome? I just want to make sure the process is entered into with eyes wide open. This post has been edited by Frazzled: Sun, 24 Jun 2018 - 00:02 |

But will a CCJ result in paying excessive charges than they are currently demanding? The usual game of escalation will commence and they'll probably issue a claim for just over £200. Do we even stand a chance of having a positive outcome? Yes, but preparation for a court hearing will be needed if they do push. -------------------- RK=Registered Keeper, OP=Original Poster (You!), CoFP=Conditional Offer of Fixed Penalty, NtK=Notice to Keeper, NtD=Notice to Driver

A quick update: a Formal Demand has been received and was dated 8 days previous to receipt of letter! They're now demanding £100 payable within 28 days from the date of the notice.
Any advice on how to proceed or useful links/cases would be most welcome although I will also do my own research too. One question though: is this a simple case of 'you didn't have permission to park, it was an access road, you made a mistake, suck it up?' Just need to be sure. Still feel annoyed as the car reg was entered into the terminal at the Centre in good faith. Thanks in advance for your help. |

You're stating a formal demand. What do you actually mean by that? And can you post it up.
