Hi,
A driver parked at M&S Car parks on the 19th January and must have exceeded the amount of time you get free parking for. I received this letter attached a few days ago stating that they have written to me before, but this is the first letter I am receiving on this. I called the debt collection agency in this letter who were very unhelpful and said I was written to twice before this, and the maximum they can reduce this fine to is £135. Edit your post so that the identity of the driver cannot be inferred, use "the driver ......" etc as appropriate.
So have you moved house recently but didn't contact the DVLA to change the details on your V5? It is not recommended to phone anyone connected with the parking charge, you could let slip details that would make it awkward. You can ignore DRP, they are merely debt collectors. You need to write a SAR to Euro to determine what documents they hold about you and your car. P.S. It's not a fine, it's an invoice. |

Please don't ever phone these people. I am assuming that you have inadvertently told them who was driving, and they will have a recording of the call. This removes a perfectly good defence point assuming they have not managed to either invoke or comply with Schedule 4 of the Protection of Freedoms Act, enabling them to pursue the Keeper of the vehicle for the charge?

How generous of them to offer time to pay under COVID-19. They have no intentions of 'helping' - unless you call helping as paying their exorbitant charge.

What are my chances of success? Is there there anything to lose in going down the route of requesting this information from them? |

Letter sent by first class post will do. Get a free certificate of posting from the post office. Do not send it by recorded/special delivery.

Don't want to do anything wrong - should I putting the PCN number in the SAR to help them identify the driver? What about vehicle registration number?

They only have keeper details. Everything is done as keeper.
Any SAR simply requests any information they hold in relation to the keeper. So in that template which was suggested, where it says:
[Your full name and address, any previous address/names and any other details to help identify you and the data you want.] Really I should just put the registration of the car and PCN number, with no name or address? |

A SAR returns personal information held in relation to a person. (So you need to supply a name and address)
