What is the name of the Constabulary? -
Date of the offence: - September 2018
Date of the NIP: - 5 days after the offence
Date you received the NIP: - 7 days after the offence
Location of offence (exact location as it appears on the NIP: important): - A5063 Albion Way, Jct Liverpool Street, Salford United Kingdom
Was the NIP addressed to you? - Yes
Was the NIP sent by first class post, second class or recorded delivery? - First
If your are not the Registered Keeper, what is your relationship to the vehicle? -
How many current points do you have? - 0
Provide a description of events (if you know what happened) telling us as much about the incident as possible - some things that may seem trivial to you may be important, so don't leave anything out. Please do not post personal details for obvious reasons - I have received a NIP for failing to comply with a traffic light signal. time into red signal was 1.4 seconds. I was driving the car at the time of the offence but not at the location named on the NIP. I was approximately 4 miles away in another direction towards my home address. In the area that I was diving in there are a number of traffic lights with cameras and it is possible that the offence may have happened at one of these. Assuming that I am guilty of committing the offence at one of these other locations, do I have any legal defence. What I don't want is for me to contest the NIP and then be served with a new NIP containing the correct details. If I am offered a diversionary training course and a conditional offer of a fixed penalty would it be far simpler to pay for and attend the course. As on completion of the course the conditional fixed penalty will be discontinued and no points applied, as indicated in the leaflet sent with the NIP. The threshold used by GMP for offering the diversionary training course for red light offences is 2.9 seconds, so it is likely to be offered to me.

Based on these responses the Wizard suggested that this course of action should be considered:
  • The law requires you to provide the information requested in the Section 172 notice within the 28 day period, naming yourself as the driver. If you are considering obtaining formal legal advice, do so before returning the notice.

    You should note that there is nothing to be gained by responding any earlier than you have to at any stage of the process. You are likely to receive a Conditional Offer of a Fixed Penalty (COFP) and further reminder(s). If you want to continue the fight, you should ignore all correspondence from the police until you receive a summons. You need to understand from the outset that while you will receive much help and support from members on the forums, you will need to put time and effort into fighting your case and ultimately be prepared to stand up in court to defend yourself.

Best thing as a starter is AFTER 14 days from the alleged offence date have elapsed (so a revised NIP cannot be sent) is a bemused call to the camera office stating you were never at the location given, it’s quite possible they will cancel it with little hassle.

You could write and ask for photos ‘to help confirm the drivers ID’ or similar wording, if they send any the background will confirm or otherwise your beleifs, then if they dint cancel you can be more confident about taking forward as a defence, that would have to be done before calling them.

Thanks for the great advice. I followed your advice and contacted GMP. After a few emails back and forth they canceled the NIP. Once again thanks for your help and advice
