I recently drove from Yorkshire to Cheshire via the M62...
After completing the trip I received notice I was doing 86 in a variable limit zone currently set to 70 at 14:21, between J28 and J27. Now a week later I've received a second one saying I was doing 87 in a variable limit zone currently set to 70 at 14:23, between J27 and J26. This was during the coivd-19 lockdown we are all currently in, the roads were dead, and I just zoomed though it as it wasn't displaying a figure on the LED screens. Am I to understand that I'll just get 4 / 5 / x amount of these and get banned? It's not just one offence? This doesn't feel like it's in the spirit of the law at all. Thanks for your time. |

This would appear to be a reasonable argument for a continuous offence, assuming you did indeed remain above the speed limit between the two detections.
You would need to contact the force involved and ask for them to cancel any subsequent notices, assuming more arrive. No guarantee they will do this but worth a try. If they fail to do this you would need to take it to court and persuade the bench that it was a continuous offence. |

I'm surprised they are week apart - the latest one arrived within 14 days?
But I agree it appears to be a continuous offence. Camera's in variable limits tend to enforce the NSL nowadays when no other limit is displayed. -------------------- RK=Registered Keeper, OP=Original Poster (You!), CoFP=Conditional Offer of Fixed Penalty, NtK=Notice to Keeper, NtD=Notice to Driver

Thanks for the quick responses people!
QUOTE I'm surprised they are week apart - the latest one arrived within 14 days? The journey was on the 18th, first one arrived 24th and second 28th. QUOTE Camera's in variable limits tend to enforce the NSL nowadays when no other limit is displayed. I've always wondered, people often seem to sail through them on the M6, this time there were literally no cars in sight most of the journey... now I know I guess. QUOTE This would appear to be a reasonable argument for a continuous offence, assuming you did indeed remain above the speed limit between the two detections. QUOTE But I agree it appears to be a continuous offence. Ok so sounds like I can try to get these bunched together, which I think is relatively reasonable, especially if I get more. I'll do that and post my results here for posterity. Thanks again. This post has been edited by riskybiscuits: Tue, 28 Apr 2020 - 19:25 |

So, good news sort of, I wrote a letter along with sending the forms back and I got the second offence removed; but due to the covid lockdown or because of the other offence I didn't get the driving school option. So 3 points + £100 for me. In the grand scheme of things it's a sensible result I think. Thanks for your guidance, common sense prevailed in this case.
