Tow legal for residential area?

My dad was visiting overnight and parked in a residential parking bay which requires a permit 10am-2pm (in Canning town). We completely forgot to put the guest permit on his dashboard in the morning at 10 am, and didn't remember until around 12pm by which time we saw it had already been towed away.

Is it legal for them to tow? I thought he would have just got a PCN ticket but had to pay the £200 tow fee too (£265 total). It was properly parked in the bay and wasn't obstructing anything.

That is what I did in going through the official complaint system online, as they have no email address which they accept emails at (unless they have given a specific person on the phone and said to email them) but I forwarded your message and the decision.

I received this reply from them, so hopefully they might process it soon:

Thank you for your recent on-line complaint in respect of the outstanding refund of monies owed to you regarding Penalty Charge Notice number PN19943358. You maintain that you are still to receive the refund of £265.00 as per the adjudicators decision on this PCN back in March 2019.

I am sorry that you felt the need to complain about this matter. As a result, I have liaised with our Business Support Team who administer all matters relating to PCN’s. In reply, I can confirm that the council accepted the recommendations made by the adjudicators when making a decision on PN19943358 and a refund request was passed to our Finance Team on 31st July 2019.

It has since been reported that the payment you made on 12th March 2019 has been processed to be refunded back to the card in which payment was made. Therefore, I would ask that you either check to see if payment of £265.00 has been refunded or to allow until early next week for this to be completed. If no payment has been received by next week, I would ask that you contact me again and I will make some further enquiries on your behalf.

I thank you for your enquiry and hope that my reply has been of some help here.

Well they're using a terminological inexactitude when they say they accepted the adjudicator's recommendation, it was a direction and the council has no discretion not to accept it. However there's no point in splitting hairs, just wait for a week and see if the money turns up.

yup that's what I thought, the whole thing is worded strangely, as if it's a reasonable time to have to wait for them to decide if they want to accept the 'recommendation' laugh.gif Yeah lets hope they actually process it in a week wink.gif

Only the Finance department can initiate repayments, nothing parking can do other than chase their initial request.
