HARD SHOULDER EMERGENCY

Hello

Im a private hire driver by trade and I had to make an emergency stop twice on the hard shoulder yesterday as my customer needed to urgently urinate, I was made aware this is a medical problem, not just a weak bladder. Both instances happened within minutes of each other.

Its the first time Ive had to stop on the M60 twice - where do i stand by law ?

My customer is happy to provide medical evidence of his problem and be interviewed by the police should anything arise.

You are permitted to stop in an emergency, what constitutes an emergency isn't rigidly defined (that would just create loopholes after all) and its for a court to decide on the individual facts of the case whether it was or wasn't.

You may have been in view of a CCTV camera (you may not) for none, one or both stops, but then they would also see the reason for the stop. Personally I think they have far better things to do EVEN IF they thought it was a (very minor) offence and you're unlikely to hear anything, if you do then post back. As this isn't (yet at least) a case it will probably be moved by one of the Mod's to the 'flame pit' forum, if it becomes a case it will get moved back for you.

Thanks for the reply.

It was in the moment... do I stop and let the customer out to so what they needed to do or have my car full of urine.

Should I pre empt by getting in touch with the police or am I throwing myself under a bus ?

I wouldn't think you'd be throwing yourself under a bus, but nor do I see you achieving anything, that's even IF they are aware of the stop(s) and even IF they are taking action and even IF you get to talk to the right person (which would be unlikely).

Nothing is going to arise, this is one of those things that only gets dealt with if an officer spots you at the time. If by CCTV you mean traffic cameras, they don't have the resolution to read number plates anyway.

No longer a universal truth but I do agree that nothing is likely to arise.
TBH, even if a traffic car happened along, as long as you were polite, doubt if much more then a telling off.
