Hi, i received a charge for unknowingly driving in a bus lane just woundering where i stand.
https://postimg.cc/zyWQJNMh This is the road that i was driving on its called dunstable road as you can see in pic i was approaching these traffic lights, in front of me was a ambulance who was in the same lane as me but further ahead in the same lane, the lane turns to bus lane so i was behind a ambulance and kept going behind it onto the bus lane, the ambulance did not have a emergency so there was me thinking it was 2 lanes as the road opposite is 2 lanes no bus lane on that side. As the Ambulance was going slow and it was rush hour about 6.30 pm i thought there was cars in front of the ambulance so was thinking I was in the right lane as you get to the top u can use the same lane to turn left or straight. Any help will be highly appreciated thanks. |

Top 123 sorry this has taken so long things just kept getting in the way, but there is plenty of time as CP pointed out.
What you should do now is to go to the tribunal portal as per the instructions on the NOR. register your appeal use the ground the contravention did no occur where they ask for submissions write full submission to follow. and submit The TPT will register your appeal and e mail you to let you know with dates by which you should submit evidence and allocate you a case number when you get this fill it in in the appeal draft along with your name, convert to PDF then send both files as evidence. Once you register your appeal the tribunal will let the council know, they then have 7 days to download a copy of the PCN a coy of your representation and a copy of the NOR. Not to worry PMB we still have time so that's fine.
Will try to submit by today but have tried to register got a couple of questions about the TPT. The vehicle belongs to my mother but it was me driving at the time so should i appeal behalf of my mother as appellant representative or should i just use my mother name and use all her details? It also says explain your appeal and add evidence, is that where you telling me to write full submission to follow. Also on the draft appeal it says cambridge county council will i not be sending the appeal to luton borough council? Thanks for the help. Top123 I'm guessing PMB might have re-used a previous draft, it needs to be amended to say Luton Borough Council. You don't send your appeal to any council, you appeal to the tribunal.
The appeal has to be registered in your mother's name but you can act as her representative, for the sake of simplicity I would do that as it mean you don't have to bother referring to yourself in the third person. Thanks CPA i have registered the appeal on TBT in mums name and put me as appellant representative and now am waiting for the council to respond.
One more question where it says appellant vs respondent on draft appeal should i write my name or mother name or both? Thanks for the replies |

So i made a appeal TBT and its saying they are waiting for authority to upload evidence. I haven't uploaded mine yet so was wondering as they are only 2 days till its 14days should i just upload my appeal or would i get a chance to when the authority uploads theirs.

You'll have a chance when the council uploads its evidence. If you run out of time, you can always ask the tribunal to re-schedule, a firsts adjournment is normally given with no fuss.
