Hi, my friend was driving my car and a manned camera got him in the back of a van. He was doing 38mph on a 30mph zone. He has a provisional license and since it was a new area we where not familiar with the roads.
My question is since he was driving can the points go on his provisional license or does it have to be some one registered on the car?
My secound question is would he get a course for this speed he was doing or straight fine and points?

Any points would go on his license, that speed qualifies for a course.

Is he insured to drive your car? You don’t have to answer but consider the consequences if for any reason he was not.

I'm not sure what concept you think there is of 'someone registered on the car?'

There is a registered keeper but that person may or may not ever drive a car (Lease cars have the Leasing company as RK, but a company clearly can never drive a car), points for speeding are always given to the driver even if they have no licence (when a virtual one is created and the points added to any substantive license they then ever get).

In addition (and same caveat about answering applies) to SP's question is whether the Provisional license holder was being adequately supervised.

Camera teams do not routinely check these things if the people involved give them no reason to, so if further offences may have been committed it makes no sense to 'rock the boat' at all.

Leaving aside the questions about L Plates ( were they used) ,The accompanying person ( presumably OP) being a full licence holder and the obligation to not allow the driver to exceed the speed limit . ( You dont have to answer about those things either OP))

What obligation? I know there's an "inciting SP30" offence but I've not heard of "allowing SP30".

I DID NOT mention any specific offence relating to what I wrote but do you think it is OK for anyone supervising a learner to allow the pupil to ( amongst other things) exceed the speed limit .....surely that goes hand in hand with being a supervisor.

Perhaps my use of the word "allow" wasn't the best but anyone with half a brain knows exactly what I meant . I also found out that it is illegal for a "supervisor" to use a mobile 'phone while supervising and also they must wear glasses if they normally wear them while driving !!!!
