Please can someone point me in the direction of TPT/PATAS/LT key cases whereby it was stated that a person cannot be expected to have an 100% accurate watch/clock? I've got a TPT adjudication where I'm four mins after the start time for a SYL.
Also, does the London Council's CEO handbook apply to EAs outside of London? Reigate and Banstead is this one. If not, is there an equivalent? Thanks! |

Hate to say it Mike but I think 4 mins may be pushing it a little far.
Reference cases I can think of tend to be within a minute and IIRC, Statutory Guidance says two minutes "grace" on yellow lines. But would need to check and is guidance not fixed in stone |

For sure.
the reason for the CEO handbook request, in case anyone is interested, is re obs periods for SYLs. Another point is that the PCN is timed at 10:04, yet the photos are times 6 hours later! I've got this covered though. |

Observation is not a grace period and as we know CEOs will issue if they are reasonably sure that there is no exempt activity despite say 5 mins observation guidance. Proving the exempt activity then does bring policy into play. |
