Like many other people I was issued a PCN for failing to give way to oncoming vehicles at Salters Hill by Lambeth council.

I found this very strange at first as the initial letter which had a photo of my car at the give way marker, had no evidence of there being any oncoming traffic. I checked the CCTV footage and there was some oncoming traffic, but it only comes into view after I'd left the Give Way marker.

Can't seem to upload any images of this unfortunately.

I challenged the appeal with the below wording and it was subsequently cancelled.

Dear London Borough of Lambeth,

The alleged contravention did not occur.

The contravention I have been accused of states that I failed to give way to oncoming vehicles and, in this case, allegedly failed to give priority to vehicles coming in the opposite direction.

However, as demonstrated by the video footage at no point did I fail to give way to oncoming vehicles, nor did I fail to give priority to vehicles coming in the opposite direction.

At the time that I drove off from the Give Way marker there is no oncoming traffic in or entering the priority area.

Furthermore the two oncoming vehicles shown in the footage are able to drive safely through the priority area without slowing down or deviating, and at no point when I drive through and exit the priority area does it prevent the priority afforded to the two vehicles.

As such no vehicle in or near in the priority area was impeded by my car and I did not fail to afford priority to any driver in or entering the priority area, thus it follows that the alleged contravention did not occur.

Please cancel the PCN.

I hope this comes in handy for anyone else who has this happen to them biggrin.gif
