Congestion Charge & ULEZ, How far has anybody gone in fighting the fines?

Hi all,

So I got stung for a CC & ULEZ driving through London on a sunny Sunday afternoon.

Obviously challenging both which I expect to lose but how far has anyone in not paying after losing a Rep?

Sending round the bailiff's I understand they can't force their way in, visit 3 times before writing off the debt and do not go on your credit file or result in a CCJ. They could take my car, but need to hide that in the garage or park on my neighbours drive (with their permission of course). smile.gif

They've set the CC to include weekends and the ULEZ I had no idea about (live outside London).

Just wondered if anyone has battled and stood firm to the end.

As i understand it, they can only break into business premises.

I heard they can only take your car if on your property or public road and also they only have 12mths to claw the money afterwhich its written off, so for all the scaremongering from the bailiffs on here, legally they have little authority or right to reclaim anything unless I invite them into my house...which isn't going to happen even if I do answer the door!

They can write it off whenever they want. They can also go back to TEC to get a new warrant for another 12 months. If they find that your car is regularly parked on your neighbour's drive, they can go back to court to get an order authorising them to take it from there (which they will get).

Of course, some people do successfully evade enforcement, but it's generally the people with no income or assets worth taking, or those who simply leave the country. For most other people it's often not worth the hassle, if it's worth the risk and hassle to you is a matter for you obviously.

Can we get back to the issue in hand, namely that the OP has yet to make reps.

And for info, 'firestone' did not win any appeal, they succeeded with reps. So IMO you should put your time and energy into making these as compelling as possible. This would probably mean being apologetic and not confrontational.

Is this possible?

Not one of the frequent fliers on this forum is going to advise letting it go to bailiffs as a sensible tactic or end game.
We have seen the results far too often and they invariably end badly.
There is no time limit, do not rely on much that you can find on the tinternet, much, especially about parking and bailiffs is twaddle.

Can we see the reps that you made (for both) and the rejection pls?

No mystery....I lost my reps for the ULEZ. I will post the NoR over the weekend.

Also, the law protects me more from the bailiffs for this kind of offence.

Will keep you posted on how I get on chaps!
