Hi Guys,

I need your advise regarding a PCN I have received couple of days ago.


PCN is issued on contravention code 27. However front wheel of my car was within raised curb. only small part of my bumper was levelled to dropped curb
but clearly wasn't obstructing the way.

I also noticed that when I parked my car in the morning there was no car parked in driveway however when I went to pick my car there was a car parked in driveway
which clearly shows there wasn't any obstruction to the driveway.

Please find enclosed PCN letter and pictures and advise if I have any chance to challenge this PCN.


Any advise will be greatly appreciated.

I would promote CP's last bit and redo the start as follows:


Dear Sir or Madam,

I am writing to formally appeal the Notice to Owner fort PCN xxxxxxxxx on the basis that the alleged contravention did not occur.

I note that your rejection of my informal representations is misinformed as to the relevant law, but concedes my car was only adjacent to the sloped part of the kerb, which is not a contravention, as I set out below. In light of this the council must cancel my PCN and it would be wholly unreasonable for you to do otherwise.

The alleged contravention falls to be considered under section 86 of the Traffic Management Act 2004, which makes it a contravention to park adjected to a kerb where:

Yesterday I received a response from Redbridge council that they have cancelled the PCN. smile.gif smile.gif

I got PCN in exactly the same location three weeks ago. I've already challenged it and am waiting for a response from the council but thought I would share my photos too!

If they reject start your own thread and post the materials - no need yet. I suspect this is due to a busybody resident calling the council 5-0.
