Parking Charge Notice - CPZ - Manchester Council - Any Advice?

Hi,

I was given a PCN on 17/06/2018 for parking on a yellow line in a CPZ.

I appealed this on the same day due to no signage on the street (which I know is not required) as this was a zone and the fact that there were no signs went entering into this particular zone.

The green directional arrows (on the image below) is the route I took before parking, as it can be seen I crossed from Zone 2 in to Zone 3. When entering Duke Street there were no signs I was entering into a controlled parking zone area and when parking on the single yellow line there was no signage across the street with any times.



After appealing on the 17/06//2018, I got an automated response saying I should get a reply within 21 days if I don't I need to send a further email to chase it up.

After 21 days I had no response and as per their instructions I re-emailed them, this time telling me I will have a response within 2 weeks.

Again no response, until now 155 days after the informal appeal where I'm served a Notice to Owner letter through the post asking for the full amount of £70.

I get on the phone to the council and ask why I have received this when I've had no response to my appeal. This is where I'm informed that they sent me a response on the 30th October to the email which I used to send the appeal, which obviously I haven't received. The lady went onto read the reason for refusal which said 'I was parked in the city centre etc etc' and that I would receive a 'Notice to Owner letter if I do not pay within 28 days of that letter' dated 30th October.

So not only did I not get a response to my appeal they sent the Notice to Owner letter within their own 28 day period (20 days exactly), which they apparently sent me via email.

The shambles all this is, I just wanted some advice if I was in a position to go fight this all the way?

This is actually my first PCN so a bit of a noob at this haha.

Any help is much appreciated.

Yes but see the map I posted. What would a reasonable person conclude? particularly given the statement in the rejection. if it is one zone it is far to big to comply with guidance so why has that guidance been ignored


Yes I agree - I was also pointing out that they are being misleading with the word zone.
